HomeMy WebLinkAboutResolutions - No. 1443RESOLUTION NO. 1443 DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF LODI TO ANNEX CERTAIN UNINHABITED TERRITORY TO SAID CITY, DESIGNATED FOR THE PURPOSES HEREOF n T. & D. ADDITION" AND MORE PARTICULARLY DESCRIBED HEREIN, IN ACCORDANCE WITH THE PROVISIONS CF THE " ANNEXATION OF UNINHABITED TERRITORY ACT OF 1939 it AS AMENDED. WHEREAS, this City Council did on the 3rd day of November, 1948, receive the request of T. & D. Jr., Enterprises, Inc., owners of more than one-fourth of the area and representing in excess of one-fourth of the assessed valuation of the uninhabited territory in San Joaquin County hereinafter described, praying that said territory, contiguous to this City, be annexed to and made part of the City of Lodi, and, WHEREAS, the City Planning Commission of this City in regular meeting held November 15, 1945, approved the annexation as petitioned, finding that the design of the lots included in said proposed annexa- tion, the construction of the building thereon and the public improve-- ment5 therein are not inferior to thoso roquired by the laws, ordinanccal and. regulations of this City, and, WHEREAS, this City Council approves the annexation of this territory as necessary to the health, convenience and protection of persons occupy- ing and using the improvements now implanted and to be implanted thereon, particularly to protect such persons from fire hazards and to protect them and abutting properties now within this City and adjoining said territory by furnishing safe and adequate water supply and connection to the sanitary sewers of this City, therefore, BE IT RESOLVED, that it is the intention of this City Council of the City of Lodi, hereby expressed, to annex said territory to this City under proceedings had and to be had in accordance with the provisions of the "Annexation of Uninhabited Territory Act of 1939," as amended. The said territory is hereby designated for identification "T. & D. Addition" and is particularly bounded and described as follows: EACH OT LOTS 1, 2, & 3, WALNUT ADDITION. Map filed March 1, 1920, in Vol. 9 Page 75 of Maps and Plats, San Joaquin County Records. Beginning on the present boundary line of the City of Lodi and on the north west corner of Lot 5, Turnage Subdivision, thence westerly across Walnut Avenue to the north east corner of Lot 3 of walnut Addition, thence west along the north line of Lots 1, 2, and 3 of said. Walnut Addition 219.114 feet to the north west corner of said Lot 1 Walnut Addition, thence Southerly on and along the west line of said Lot 1 to the south west corner thereof, thence west 219.114 feet aloIlL the south line of Lots 1, 2, and 3 of said Walnut Addition to the south east corner of said Lot 3, thence east across Walnut Avenue sixty feet, more or less, to a point on the west line of Turnage Addition, andsaid point being on the present boundary line of the City of Lodi, thence north 00 42' U'on and along the said west line to the north west corner of Lot 5 in said Turnage Addition and the point of beginning of the tract to be annexed, containing one acre more or less. -2- Reference is here made to a map on file in the office of the City Clerk of this City for further particulars and greater certainty. BE IT FURTHER RESOLVED, and notice is hereby given, that this City Council has fixed Wednesday, December 15, 1943, at the hour of 8:00 P. M. and the City Council Chambers, City Hall, Lodi, California, as the time and place when and where protests or objections to this proposed annexa- tion will be received, heard, and considered from property owners affected thereby. Such protests or objections must conform to the provisions of Section 6 of the act under which it is proposed to annex this territory. The City Clerk will give notice of the adoption of this Resolution and of the date of hearing set herein, by causing the same to be pub- lished for at least two consecutive weeks in THE LODI TIM1S , a weekly newspaper printed and published in this City and hereby designated for this purpose. 0 I, J.
