HomeMy WebLinkAboutResolutions - No. 1442RESOLUTION NO. 1442 DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF LODI TO ANNEX CERTAIN UNINHABITED TERRITORY TO SAID CITY, DESIGNATED FOR THE PURPOSES HEREOF " COSTA ADDITION " AND MORE PARTICULARLY DESCRIBED HEREIN, IN ACCORDANCE WITH TIE PROVISIONS OF THE " ANNEXATION OF UNINHABITED TERRITORY ACT OF 1939," AS AMENDED. WHEREAS, this City Council, proposes to annex certain unin- habited territory in San Joaquin County, contiguous to the City of Lodi for the following reasons to -wit. (1) Lodi School District has pur- chased a tract of twelve acres on which it is proposed to erect a school building which must be connected to this City's water supply and sewage system and be protected from fire by the City fire protec- tion facilities. (2) New dwellings have been or are to be erected on parts of the proposed territory that should conform to this City's ordinances regarding the erection and placement of the same and be occupied and used in conformance with City zoning laws as well as being connected to the City sewers and its water supply as a protection to the health and safety of persons now residing within the corporate limits. (3) The development of the lands comprising the proposed territory to be annexed should be in conformance with this City's plans, particularly as to the location, width and general plan for streets, highways, and public places, and WHEREAS, the City Planning Commission of the City of Lodi has approved and recommended this annexation, therefore, BE IT RESOLVED, that it is the intention of this City Council of the City of Lodi, hereby expressed, to annex said territory to this City pursuant to proceedings to be had in accordance with the pro- visions of the "Annexation of Uninhabited Territory Act of 1939," as amended. The said territory is hereby designated "Costa Addition" as -1- an appropriate name for identification, and is particularly bounded and described as follows: A portion of the Northeast One Quarter of Section Two, Town- ship Three North, Range Six East, (Sect 2, T 3 N, R 6 E, M. D. B. & M.) Beginning on the present city boundary line where the southerly extension of the east line of Grant Avenue intersects the northerly line of the Southern Pacific Company, Woodbridge Branch Rail- road right of way, (formerly San Joaquin and Sierra Railroad), and running thence Southerly on the extended east line of Grant Avenue to the north line of West Lockeford Street, thence Westerly on said north line to its intersection with the west line of Lot Six (6) in Block Thirteen (13) of Hutchins Addition to Lodi, ex- tended northerly, thence Southerly on said extended west line across Lockeford Street and following the present city boundary line to the south line of Lockeford Street, thence Westerly on and along the south line of Lockeford Street to the Northwest corner of Lot One (1) in "Cainard Subdivision," thence N 0° 1411E on the extension of the west line of said Lot 1 thirty (30) feet more or less to the center line of West Lockeford Street, thence S 85° 45t E on said center line to a point thereon 760.32 feet from the west line of the NE4 of Section 2, Township 3 North, Range 6 Bast, said point being the southwest corner of that cer- tain 1.40 acre tract of land deeded by Gar10 Peirano and Luigii Peirano to Lodi School District by deed recorded September 30, 1948, thence N 0° 48' W along the west line of said School District property and its northerly extension 1074.90 feet, more or less, -2- to the north line of the Southern Pacific Company Woodbridge Branch railroad right of way, thence 3 67° 241 E on and along said north line to its intersection with the southerly production of the east line of Grant Avenue and the point of beginning of the tract of land herein described and proposed to be annexed. Reference is here made to a map on file in the office of the City Clerk of this City for further particulars and greater certainty. BE IT FURTHER RESOLVED, and notice is hereby given, that this City Council has fixed Wednesday, December 15, 194, at the hour of 8:00 P. M. and the City Council Chambers, City Hall, Lodi, California, as the time and place when and where protests or objections to this proposed annexation will be received, heard and considered from property owners affected thereby. Such protests or objections must conform to the ,provisions of Section 6 of the act under which it is proposed to annex this territory. The City Clerk will give notice of the adoption of this Resolution and of the date and place of hearing set herein, by causing the same to be published for at least two consecutive weeks in THE LODI TIMES, a weekly newspaper printed and published in this City and hereby designated for this purpose. 0 I, J. BLAYELY, City Clerk of the City of Lodi and ex -officio Clerk of the City Council thereof, do hereby certify that the foregoing Resolution No. 1442 was regularly introduced, passed and adopted in regular meeting of the said City Council held November 17, 1948, by the following vote: AYES: Councilmen, Bull, Haskell, Lytle, Tolliver, and Rinn.
