HomeMy WebLinkAboutResolutions - No. 1429 SMRESOLUTION NO. /41 BE IT RESOLVED, By the City Council of the City of Lodi, San Joaquin County, California, that there shall be and is hereby appropriated out of the general fund of said city the sum of Six Thousand Five Hundred Dollars for the purpose of purchasing in the name of said city the real property hereinafter described, and that the proper warrant shall be drawn upon the funds of said city payable to Stockton Abstract and Title Company to be delivered to said Stockton Abstract and T±tle Company in escrow for the following purposes: With the said sum of $6500.00 the said city shall purchase real property situated in the County of San Joaquin, State of California, and being the West one-half of all the following described real property, to -wit: The Northeast Quarter of Section Nineteen, Township Three North, Range Eight East, Mount Diablo Base and Meridian. EXCEPT the West sixty acres of said quarter section. ALSO EXCEPT that certain strip of land conveyed to East Bay MUnicipal Utility District by Deed dated. September 13, 1927, and recorded October 7, 1927, in Book of Official Records, Vol. 201, page 261, San Joaquin County Records. The land so to be conveyed contains 50 acres, more or less. The said title company shall pay the said sum of $6500.00 to the seller or sellers of said real property upon the title to said real property being vested in the City of Lodi free and clear of all liens, clouds and encumbrances except: 1. State and county taxes for the fiscal year 1948-1949 which the city assumes and agrees to pay. 2. Right of Way for electric transmission line as granted to Pacific Gas and Electric Company, a corporation, by Deed recorded in Book "A" of Deeds, Vol. 252, page 540. 3. Right of way for road along the North line of the. property hereinabove described. -1- 4. Also except that certain strip of land conveyed to East Bay Municipal Utility District by deed dated September. 13, 1927, and recorded October 7, 1927, in Book of Official Records, Vol. 201 page 261, San Joaquin County Records. BE IT FURTHER RESOLVED That Glenn West, City Attorney of said City, is authorized and directed to deliver the said warrant to said title company for the above purposes and to sign all necessary or proper escrow instructions upon behalf of the said city. 1, J.
