RESOLUTION NO. 1375
?ESOLUTION AMKIDING CCNTRaCT.
rP. ,L , it is to the mutual benefit of the parties thereto, in
order to modify the order of delivery and sizes of pipe to be delivered and
to expedite the delivery of certain sizes of said pipe, that that certain
contract &ted April 2, 194? by and between Johns- Manville Sales Corporation
and this City be amended, therefore,
BE IT RESOLVED, that said contract be, and the same is hereby amen-
ded by adding thereto the following three paragraphs which shall have the full
force and e,fect <s if the same had been incorporated in the original contract:
1. That first party (Johns. -Manville) shall take the necessary
action to deliver one-half of the tonne of pipe not delivered
in,Noveiaber, 1947 in the month of December of the same year
at the prices •quoted in the. contract of Ilri1 2, 1947.
2. That the balance of pipe undelivered under (1) above shell be
delivered in the month of 7anuary, 1948 at prices iri effect
at the time cf such delivery.
3. That the City of Lodi (second party) shall have the privilege
of specifying footages and sizes of pipe to be delivered up
to end including 183.59 tons in the month of December, 1947,
such sizes to be only those a1nearing in the original contract
end said City of Lodi shall have the right and privile-e of
specifying footases and sizes for ell of the remaining balance
of pipe to be delivered in Jnunry, 1948, or may, at its option,
cancel such 7anuary deliveries should the prices then in effect
be unsatisfaetory.
The City Clerk shall make and certify a cony of this Resolution
and forward the same to Johns -Manville Sales Corporation for their a•,proval
and these iaendsients shall he effective thereafter.

the City Council of the City of Lodi as passed and
adopted in regular meeting of said City Council held
November 5, 1947.
