RESOLUTION 132 WHEREAS, the City of Lodi is acquiring from Fredrickson and Watson Construction Company a parcel of land in Section 31, T3N, R7E containing forty acres, more or less, and, WHEREAS, by error, inadvertence and mistake the former owners piled earth stripped from a borrow pit located on the forty acres above mentioned on San Joaquin County Roadways bordering said property on the North and on the South, and, WHEREAS, it is necessary that this City enter into immediate possession of the said forty acre parcel of land before the earth on these roadways is removed, therefore, BE IT RESOLVED, that the City of Lodi, jointly with Fredriekaon and Watson Con$truction Company, make and enter into an agreement with the Board of Supervisors of San Joaquin County, California which said agreement is as follows: (1) Should the City of Lodi desire to open these roads or either of them easterly along the borders of its land, said City will at its sole cost remove the piled earth from these roads. (2) Should San Joaquin County demand, in the future, that these roads or either of them be cleared from the earth piled upon them for any other purpose than one proposed or abetted by the City of Lodi, then Fredrickson and Watson Construction Company will remove the said earth Or pay for removing the same. RESOLVED, further, that this City Council approve a letter dated August 19, 1947 written by Fredrickson and Watson Construction Company and addressed to the Board of Supervisors of San Joaquin County similar in intent and effect as set forth above in this Resolution.
