HomeMy WebLinkAboutResolutions - No. 1321City of Lodi Lodi, California RESOLUTION NO. 1321 AN ORDER VACATING CERTAIN EASEMENTS IN "TURNAGE ADDITION" IN THE CITY OF LOM WHEREAS, in answer to a petition signed by all the owners of the roperty thereby affected, this City Council did, on the 23rd day of April, 1947 regularly pais and adopt its Ordinance No. 346-A declaring said City Councils intention to vacate certain easements described therein in "Tract 100, Subdivisions of San Joaquin County, Map of Tur- nage Subdivision," and; WHEREAS, publication and posting of said ordinance and the notice's required therein and by statute was had in time, for and manner as required by law as is evidenced by affidavits on file and of record in the office of the City Clerk of the City. of Lodi, and, WHEREAS, the said Ordinance No. 346.A, among other things, gave public natio' that a hearing mould be held before said City Council on Wednesday, the 214 day of May, 1947 in the City Council Chambers; City Hall, Lodi, California, when and Where interested persons mould be heard and evidence Considered against the vacation of the ease- ments proposed to be vacated, and, WHEREAS, at the above stated time, hour and place, said hearing was held and conducted and no objections were offered either oral or in writing nor was any evidence submitted that said easements should be continued in effect, now therefore, This City Council does hereby find, determine and declare that the easements hereinafter described are not necessary for present or prospective public use: that no o jactione to the vacation of the slate have been made or offered and that all proceedings herein, have 40n had end taken at the times and in the manner prescribed by law and ordinance; therefore, BE IT RESOLVED, that the following described public easements as shorn on the official map of "Turnage Addition" referred to first a, hove in this resolution, be and the name are hereby ordered vacated, vis; (1) Over the Southerly semen and one-half (77) feet of each of lots 2, 3, 4 and and over the Nor- therly seven and one-half (7) feet of each of Lots 6 and 21. (2) Over the Easterly seven and one-half (7i) feet of each of Lots 6 to 13 inclusive and over the Westerly seven and one-half (7i) feet of each of Lots 14 to 21, both inclusive. (3) Over the Southerly sawn and ons -half (7i) fest of each of Lots 13, 14 and 27 and over the Baster. ly seven and one-half (?}) feet of Lots 24, 25, 26 and 27. Upon the adoption of this resolution and order of vacation, than City Clerk shall cause a certified copy thereof under seal of this City to be recorded in the office of the County Recorder of San Joaquin County, California. ---0 1, J.
