RESOLUTION NO. 1315 RESOLUTION OF AWARD—STREET &FZPER 1'PHEREAS, in accordance with proceedings regularly had, and after due publication of notice thereof, this City Council did, on the 16th day of April, 1947, receive and publicly open and declare all sealed bids or proposals submitter:' for furnishing the City of Lodi one mech- anical street sweeper, and, "ERf,AS, on the said 16th day of April, 1947, by motion regularly made, seconded and carried, all bids received as above set forth were referred to a committee consisting of Councilman Lytle, City Engineer Henning and. Street Superintendent Bruner with the direction that they investigate and report thereon, with recommendations as to the street sweeper best suited to the needs of this City, and, WHEREAS, said Committee has at this time and place submitted the following recommendation:' That the City purchase one Model 40 Austin- 7estern Sweeper from Edward R. Bacon Company, therefore, BE IT RESOLVED, that award of contract be, and the same is hereby made to EDWARD R. BACON COMPANY, FOLSOM & 17th STREETS, SAN FRANCISCO 10, CALIFOFNIA, FOR ONE M0DEL 40 -AUSTIN WESTERN SWEEPER WITH LEAF BROOM, at the price named in its proposal., to -wit, at the price of $6325.26 as the lowest and best bid received. Provided however, and in accordance with the terms and conditions set forth in said Companys bid, should the price at time this sweeper is delivered be in excess of 5% over and above the price offered, this City reserves the right to cancel this award on notice from the successful bidder of such price increase, and, provided further that if the price in effect at the time of delivery is less than that stated in said Companys hid, the City of Lodi willbe allowed the advantage of such lower price. The City Clerk is hereby directed to return the bidding deposits of unsuccessful bidders ars' that of the successful bidder on receipt of formal acceptance of the award made herein. Certified to be a full, true and correct copy of Resolution N as passed and adopted by the City Council of the City of Lodi in to rePu1ar meeting held April 23, 1947, by the following vote: ;;x ES: COUlCIWEN: Rigs, Lytle.
