HomeMy WebLinkAboutResolutions - No. 2475RESOLUTION NO. 21+75 RESOLUTION GIVING NOTICE CE PROPOSED ANNEXATION TO CITY CF LODI OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESKNTATED "CHEATHAM ADDITION," AND GIVING NOTICE OF TIME AND PLACE FOR HEARING CF PROTESTS THERETO BE IT RESOLVED BY THE COUNCIL CF THE CITY CF LODI: 1_ That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939; a petition signed by owners of not less than one-fourth of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roll of the County of San Joaquin, was filed with the Council of the City of Lodi on October 4, 1961, requesting annexation of the hereinafter described territory to said City. 2 That the territory which the petitioners request be annexed to the City of Lodi and which said City and its Council propose to annex, is situate in the County of San Joaquin, State of California, hereby designated "Cheatham Addition," and described as follows: A portion of the Northeast Quarter of Section 11, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, San Joaquin Comity, California, and more par- ticularly described as follows: Beginning at a point on the West line of the North- east Quarter of Section 11, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, which point is 386.38 feet north of the Southwest corner of said Quarter Section; thence northerly 1127.58 feetalong said West line, this line being also a City Limit Line of the City of Lodi, to a corner of the City Limits; thence easterly 717.33 feet along a line parallel to the South line of said Quarter, also a City Boundary line, to the East line of Fairmont Avenue; thence southerly 1127.58 feet along the East line of Fairmont Avenue, also a City boundary line, to a point; 1. thence westerly 717.33 feet along a line parallel to the South line of said Quarter to the point of beginning; the area thus described containing 18.50 acres, more or less. 3. That the County Boundary Commission of San Joaquin County, California, did in session duly assembled on Tuesday, August 15, 1961, consider and approve the proposed annexation boundaries of said "Cheatham Addition," as above described, and as submitted to said Commission by the proponents of said annexation. 4. That Wednesday, November 15, 1961, at the hour of 8 p.M. , In the Council Chambers in the City Hall in the City of Lodi, County of San Joaquin, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Lodi, and having any objections to the proposed annexation, may appear before tha Council of the City of Lodi and show cause why such unin- habited territory should not be so annexed to the City of Lodi. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the flame or names of the owner or owners of property affected and the description and area of such property, in general tsrms. 5. Tho City Clark of trio City of Loui is hereby authorized and directed to cause a oopy of this resoluOion to be published at least twice, but not oftener than once a week, in the Lodi News - Sentinel, a newspaper of general circulation published in said City of Lodi, the city to which it is proposed to annex the aforesaid territory, and also in the Stockton Record, a newspaper of general circulation published outside the City of Lodi, but in the County of San Joaquin, California, the county in which is located the terri- tory proposed to be annexed to the City of Lodi, said publication 2. to be complete at least twenty (20) days prior to the date set for hearing. 6. The said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to viten land within the territory proposed to be annexed was assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with said Clerk,such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 7. In the event there is, upon the land proposed to be annexed to said City, a structural improvement owned, being acquired or leased by a county fire protection district, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, sueh`riotice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 8. The City Clark is dilleuted t u cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
