HomeMy WebLinkAboutResolutions - No. 246511,4 C a 1111�� RESOLUTION GIVING NOTICE CF PROPOSED ANNEXATION TO CITY CF LODI OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESCNATFD "NATHAN ADDITION " AND GIVING NOTICE CF TIME AND PLACE FOR HEARING N PROTESTS THERETO. BE IT RESOLVED BY THE COUNCIL CF THE CITY OF LODI: 1_ That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of all of the land in the hereinafter described territory, be area and by assessed value as shown on the last equalized assessment roll of the County of Saxe Joaquin, was filed with the Council of the City of Lodi on August 16, 1961, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioriers request be armexed to the City of Lodi and which said City and its Council propose to annex, is situate in the County of San Joaquin, State of California, hereby designated "Nathan Addition," and described as follows: A portion of the Northeast Quarter of Section 13, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, San Joaquin County, California, and more par- ticularly described as follows: Beginning at a point on the North iisie of Lot 3, "A. J. Larson's Subdivision" of the Northeast Quarter of Section 13, Township 3 North, Range 6 East, Mount Diablo Base and M®rtdian',� as filed for record on November 7, 1890 in Volume 2, page 41 Maps and Plabs, San Joaquin County Records, which point is 200 feet west of the west line of the State Highway 99, conveyed to the State of California by deed recorded December 26, 1930 In Volume 351, page 218, San Joaquin County Records; thence southerly along a line parallel to said west line of State Highway, also a boundary line of the City of Lodi, 350 feet more 1. Or less to the southwest corner of the parcel conveyed to Henry Gunsch by deed recorded August 11, 1955 in Volume 1778, page 599, San Joaquin County Records; thence westerly 20 feet along a line parallel to the north line of Almond Drive; thence southerly 521.56 feet along a line parallel t0 the west line of said State Highway to the north line of Almond Drive; thence westerly 352.6 feet along the north 11.ne of Almond Drive to a point; thenae North 0° 39' West a distance of 868.3 feet to the north line of Lot 3, "A. J. Larson's Subdivision of the Northeast Quarter of Section 13, T3N, R6E, Ni B&K; K thence easterly 372.4 feat along the north line of said Lot 3, also a City Limit Line, to the point of beginning; the area thus described containing 7.2 acres, more or less. 3. That the County Boundary Commission of San Joaquin County, California, did in session duly assembled on Tuesday, August 15, 1961, consider and approve the proposad annexation boundaries of said "Nathan Addition," as above described, and as submitted to said Commission by the, proponents of said annexation. 4. That Wednesday, September 20, 1961, at ttie hour of 8 p.m., in the Council Chambers in the City Hall in the City of Lodi, County of San Joaquin, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Lodi, and having any objections to the proposed annexation, may appear before the Council of the City of Lodi and show cause why such uninhabited territory should not be so annexed to the city of Lodi. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms . 5• The City Clark of the City of Lodi is hereby authorized and directed to cause a coPY of this resolution to be published at least 2. LI twice, but not oftener than once a week, in the Lodi News -Sentinel, a newspaper of general circulation published in said City of Lodi, the city to which it is proposed to annex the aforesaid territory, said publication to be complete at least twenty days prior to the date set for hearing. 6. In the event there is, upon the land proposed to be annexed to said City, a structural improvement owned, being acquired or leased by a county fire protection district, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed an.nezat ion. 7. The City Clerk is directed to Cause written caotice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
