HomeMy WebLinkAboutAgenda Report - May 15, 1996 (94)AGENDA TITLE: Acceptance of Improvements Under Almond Drive Street Improvements, Stockton Street to Cherokee Lane Contract MEETING DATE: May 15, 1996 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council accept the improvements under the "Almond Drive Street Improvements, Stockton Street to Cherokee Lane" contract and direct the City Engineer to file a Notice of Completion with the County Recorder's office. BACKGROUND INFORMATION: The project was awarded to George Reed, Inc. of Lodi on June 7, 1995 in the amount of $103,379.00. The contract has been completed in substantial conformance with the plans and specifications approved by the City Council. The contract completion date was August 24, 1995, and the actual completion date was September 1, 1995. As discussed below, George Reed, Inc. was not given their full contract unit price for the asphalt paving portion of this project. Negotiations regarding this pay reduction contributed to the delay in accepting this project. The final contract price was $122,650.47. The difference between the contract amount and the final contract price is mainly due to the installation of water and sewer services which were done by the contractor because City crews were unavailable for this work during the construction of the street. We have changed our specifications to incorporate a pay reduction factor for the asphalt paving portion of the contract because studies have shown that a lack of compaction in the asphalt decreases the life the pavement. Our specifications now require the contractor to compact the paving to a minimum 93% of its maximum theoretical density. Should the compaction of the asphalt be between 90% and 93%, the contract unit price for the asphalt concrete is reduced by 15%. All asphalt that fails to meet 90% compaction is to be removed and replaced. The compaction tests taken on this project did not meet the 93% compaction requirement and the contractor was assessed a 15% pay reduction ($5,682.57) for the asphalt work. George Reed, Inc. is protesting this pay reduction and will be filing a claim with the City. George Reed, Inc. feels it is unreasonable to require the contractor to attain 93% compaction on the paving. The City's paving consultant, CHEC Consultants, has reviewed the test procedures and the actual paving on Almond Drive and agrees the City is justified in reducing the payment for the asphalt. CHEC Consultants has worked with other cities in California in preparing asphalt specifications with pay reduction factors, so contractors are not unfamiliar with this a of sp cification.
