HomeMy WebLinkAboutResolutions - No. 2321itk;SOLUTION NO. 2321 RESOLLJTIUN GIVING NOTICE CF PROPOSED "NEXATZ9N TO CITY CF LODI CF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESKNATFD 'HARRECIN ADDITION " ASW GIVING NOTICE OF TINE AND PLACE FOR HEARING OF h0ft, #r8 THERETO BE IT RESCLVtD BY THE COUNCIL OF THE CITY CF LODI: 1. That, pursuant to the provisions of the knraexaation of Uninhabited Territory Act of 1939, a petition signed by owners of all of the land in tha hereinafter described territory, by area and by assessed value as shown on the last equalized assessmant roll of the CouiLty of Sari Joaquin, was filed with the Council of the City of Lodi ou try 18, 1960, requesting annexation of the hereinafter described territory to said City. 2. Thdt the territory which the petitioners request be at�ri�xetl to tho City of Lodi and which said City and its Council propose to annex, is situate in the County of San Joaquin, State of California, hereby designated "Harrison Addition," and desoribed as follows: A portion or the Southwest quarter of Section 2, 'luwriahip 3 North, Range 6 East, Mount Diablo Base and Meridian, County of Bran Joaquin, State of California, and quare particularly described -us follows: Begltning at a point on tha Suuth line of, ttre Buutnwest Quarter of Section 2, Township 3 North, h4uge 6 East, Mount Diablo Base and Meridian, which point Is 25 feet west of the Southeast corner of said quarter; thence westerly along the South line of said Quarter 239.0 feet to the extended West line of the Runnels property, as shown on map filed in Volume 5, page 290, Record of Surveys, San Joaquin County Recurds; thance northerly along said West line and the West lirla of the Stephen$ property shown on said survey 456.0 feet to the north line of said Stephens property$ thence easterly along the North line of said Stephens property, which line 1. is also a boundary line of the City of Ludi, 239.0 feat to the West line of Ham Lane (Hutchins Road); thence southerly along the West line of Ham Lane, which line is also a City boundary line, 456.0 feet to the point of beginning; the area thus described containing 25 acres, more or less. 3. That the County Boundary Co=issioa of San Joaquin County, California, did in session duly assembled on Monday, April 11, 1960, consider and approve the proposed annexation boundaries of said "Harrison Addition," as above described, and as submitted to said Commission by the proponents of said annexation. 4. That the petitioners further request that tare territory proposed for annexation take the zoning classification of C-1 Commercial to become effective coincidesat with the effective date of the aanexat,ion as provided in Section 4.2 of Ordinance No. 469 of the City of Lodi. 5. That Wednesday, July 6, iy,W, dt the tioux Of b p.m., ILI the Council Chambers in the City Hall in the City of Lodi, County of San Joaquin, California, is hwreby fixed as the time and place wird atid where a W person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Lodi, and having any objeutioiis to the pruposed annexation, may appear beforts the Council ei' the City of Lodi and show cause why such unin- habited territory should not be so annexed to the City of Lodl. The Protest must be in writing, may be filed at any time before the hour set for heariA. objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, ix4 general terms. 6. The City Clerk of the City of Lodi is hereby autfwrizdd and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the "Lodi News - Sentinel," a newspaper of general circulation publishad in said City 2. of Lodi, the city to which it is proposed to annex the aforesaid territory, said publication to be complete at least twenty days prior to the date sdt for hearing. 7. In the event there is, upon rite land proposed to be ann((Xed to said City, a structural improvement owned, being acquired or leased by a county fire protection district, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten days before the first public hearing upon such proposad annexation. 8.
