HomeMy WebLinkAboutResolutions - No. 2295RESOLUTION NO. 2295 RESOLUTION GIVING NOTICE CF PROPOSED ANNEXATION TO CITY OF LODI OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNAIE,1) "ZORNIG ADDITION" AND GIVING NOTICE OF TIME AND PLACE FOR HEARING � PROTESTS THERETO RE IT RESOLVED BY THE COUNCIL OF THE CITY OF LODI: 1_ That, pursuant to provisions of Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of all of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roll of the County of San Joaquin, was filed with the Council of the City of Lodi on February 24, 1960, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be annexed to the City of Lodi and which said City and its Council propose to annex, is situate in the County of San Joaquin, State of California, hereby designated "Zo.rnig Addition", and described as follows: A portion of the Southeast Quarter of Section 11, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, San Joaquin County, California, and more par- ticularly described as follows: Beginning at a point on the West line of the Southeast Quarter of Section 11) Township 3 North, Range 6 East, Mount Diablo Rase and Meridian, which point is 25.00 feet north of the Southwest corner of said Quarter and situated on the North line of Kettle - man Lane; thence North 0° 10' East along the West line of said Quarter, which Is also a boundary line of the City of Lodi, 1641.5 feet to the Southwest corner of a certain parcel deeded to the Lodi Memorial Hospital Association, Incorporated, as filed for record on June 11, 1948 in Volume 1122, page 485, 1. San Joaquin County Records; thence South 89° 30' East along the South line of said Lodi Memorial Hospital Association property, said line also a boundary line of the City of Lodi, 660 feet to the West line of Fairmont Avenue (formerly Walnut Avenue); thence South 0° 10' West along the West line of Fairmont Avenue 1645.8 feet to the North line of Kettleman Lane; thence North 890 West along the North line of Kettleman Lane 660.0 feet to the point of beginning; the area thus described contain- ing 2+.90 acres, more or less. 3. That the County Boundary Commission of San Joaquin County, California, did in session duly assembled on December 2%, 1959, con- sider and approve the proposed annexation boundaries of said "Zornig Addition" as above described and as submitted to said Commission by the proponents of said annexation. 4. That April 6, 1960 at the hour of 8 p.m., in the Council Chambers in the City Hall in the City of Lodi, County of San Joaquin California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Lodi, and having any objections to the proposed annexation, may appear before the Council of the City of Lodi and show cause why such uninhabited territory should not be so annexed to the City of Lodi. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 5. The City Clerk of the City of Lodi is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the "Lodi News- Sentinel", a newspaper of general circulation published in said City of Lodi, the city to which it is proposed to annex the aforesaid 2. territory, said publication to be complete at least twenty days prior to the date set for hearing. 6. In the event there is, upon the land proposed to be annexed to said City, a structural improvement owned, being acquired or leased by a county fire protection district, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten days before the first public hearing upon such proposed annexation. 7. The City Clerk is directed to cause wrltten notice to be given to such other persons as may be legally entitled thereto, in the manner required by law. Certified to be a full, true and correct copy of Resolution No. 2295 of the City Council of the City of Lodi and that the same was passed and adopted in a regularly adjourned meeting of said Council held February 24, 1960 by the following vote: Ayes : Councilmen - Culbertson, Katzakian, Mitchell, Robinson and Brown Noes; Councllmen - None Absent: Councilmen - None BEATRICE GARIBALDI City Clerk 3.
