Evans, Assistant to the City Manager RECOMMENDED ACTION: That City Council by motion action adopt a resolution for the City of Lodi NonDisposal Facility Element. BACKGROUND INFORMATION: The California Public Resources Code section 41730 et seq, requires every City and County in California to adopt a NonDisposal Facility Element (NDFE) for existing or proposed nondisposal facilities needed to implement their Source Reduction and Recycling Elements (SRRE). In San Joaquin County, a disposal facility is a landfill. A nondisposal facility is any solid waste processing facility required to obtain a solid waste facility permit. It is not a landfill. There are only two material processing nondisposal facilities required to implement the City of Lodi SRRE. They are not planned - they exist today. The first is a Materials Recovery Facility (MRF) owned by California Waste - 1333 E. Turner Road. This facility processes the great majority of residential, commercial and industrial waste generated in Lodi. The second is a MRF located close to the entrance of the North County Recycling Center & Sanitary Landfill on east Harney Lane. This facility processes any waste generated in the City of Lodi which does not pass through the California Waste MRF (e.g. self -haul waste or industrial waste collected by Stockton Scavenger Assn.). The attached document describes these facilities and indicates they will be used to meet our diversion goals as mandated by AB939. For most cities in California the NonDisposal Facility Element is a very simple document. The necessity of such a document becomes more apparent in larger jurisdictions where much more complex SRREs and NDFEs are required. Solid waste management plans in these areas encompass a broad assemblage of processing and disposal facilities. The San Joaquin County Integrated Waste Management Task Force has reviewed the City of Lodi NDFE and determined it meets their goals and policies. The California Integrated Waste Management Board requires City Council to also review this document and submit an adopted NDFE to them. FUNDING: N/A K(irk J. At its meeting on November 30, 1994, the Task Force reviewed Lodi's "Nondisposal Facility Element" and determined that it meets the Goals and Policies established by this Task Force. LM c: David Baker, County Administrator PL 23701 RESOLUTION NO. 96-54 A RESOLUTION OF THE LODI CITY COUNCIL ADOPTING THE CITY OF LODI NONDISPOSAL FACILITY ELEMENT (NDFE) WHEREAS, the definition of a Nondisposal Facility is any solid waste processing facility required to obtain a solid waste facility permit that is not a landfill; and WHEREAS, there currently exist two materials processing nondisposal facilities required to implement the City of Lodi Source Reduction and Recycling Element (SRRE). The first being the Materials Recovery Facility (MRF) owned by California Waste located at 1333 E. Turner Road, and secondly, the MRF located close to the entrance of the North County Recycling Center & Sanitary Landfill on East Harney Lane. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lodi hereby adopts the City of Lodi Non -Disposal Facility Element (NDFE) as shown on Exhibit A attached hereto and made a part of this Resolution. INTRODUCTION The California Integrated Waste Management Act of 1989 (Act) requires each City and County to meet 25% waste diversion goals by 1995 and 50% by the year 2000. The Act further requires each City and County (for unincorporated areas) to prepare Source Reduction and Recycling Elements (SRRE) that indicate the programs and strategies that will be implemented by the jurisdictions to achieve their waste diversion goals. In accordance with the Act, the City of Lodi has prepared a SRRE that identifies programs which will be implemented to achieve its waste diversion goals. The California Public Resources Code (PRC), Sections 41730 et seq, requires every California City and County to prepare and adopt a Nondisposal Facility Element (NDFE) for all existing and proposed nondisposal facilities which will be needed to implement their SRREs. A nondisposal facility is defined as any solid waste facility required to obtain a solid waste facility permit other than solid waste disposal and transformation facilities. This NDFE has been prepared by The City of Lodi to meet the PRC requirements. II. FACILITIES REQUIRED The City's SRRE has determined that transfer stations, materials recovery facilities, and compost facilities will be utilized to meet the City's waste diversion goals. California Waste Removal Systems, Inc., is the City's franchised collector for residential, commercial and Industrial waste generated within the city. This firm operates a transfer station, material recovery facility and a compost facility on Turner Road within the City. Waste collected within the City is taken to this facility for processing. Also, self hauled waste is accepted at this facility and processed as well. Self hauled waste from within the City is also accepted at San Joaquin County's North County Recycling Center and Sanitary Landfill located on Harney Lane about nine miles east of the City. Both of these facilities will be utilized by the City to meet 1995 and year 2000 waste diversion goals. Title 14, Article 6.4, Section 18752 (e) states that "A city or county may include other facilities not defined as Nondisposal facilities (i.e. recycling centers, drop-off centers, HHW facilities, etc...)." There are other drop-off type recycling centers within the City. This NDFE only addresses facilities with Solid Waste Facilities Permits and other major facilities important in meeting waste diversion goals. The facilities listed above are described in the following tables. NONDISPOSAL FACILITY ELEMENT 2 TYPE OF FACILITY FACILITY CAPACITY EXPECTED DIVERSION RATE Greater than 5% PARTICIPATING JURISDICTIONS LOCATION Existing Facility - This facility, owned and operated by California Waste Removal Systems, Inc., is a MRF and transfer station which accepts and processes source separated residential and commercial/industrial materials. In addition, yard waste and other organic material is accepted and composted on site. Materials which cannot be recycled are transferred to the North County facility and landfilled. The California Waste Removal Systems Facility is permitted to receive 2000 tons per day for the transfer station and Materials Recovery Facility combined. Currently, the facility receives about 1,000 tons per day. The compost facility handles about 400 tons per day. It is anticipated that this facility will be expanded to handle additional compost and recyclables. Currently, about 28% of the waste passing through this facility is diverted from the waste stream. It is anticipated that this diversion will increase up to 50% by the year 2000. City of Lodi and Refuse Service Areas A & B. This facility may also be used to process green and other wood waste collected in the Central County area. Located at 1333 East Turner Road, within the City of Lodi. NONDISPOSAL FACILITY ELEMENT 3 TYPE OF FACILITY I FACILITY CAPACITY EXPECTED DIVERSION RATE Greater than 5% PARTICIPATING JURISDICTIONS LOCATION Existing Facility - San Joaquin County owns and operates the Recycling Center at the NCRCSL which is a MRF at the landfill that receives and processes mixed municipal and pre-sorted waste from Areas A&B. Recyclable materials, such as metals, newspaper, cardboard, plastic, yard waste, and others, are pulled from the waste stream manually, and the residual material is landfilled on-site. Yard waste is currently taken to other facilities for processing. In the future, an area may be designated for composting on-site. Mechanized equipment will be added in the future to help meet waste diversion goals. The NCRCSL is currently permitted to process a peak of 825 tons per day. Currently, the site receives an average of 425 tons per day. About half of this waste is processed at other facilities and taken directly to the landfill. In 1995, the other half will be processed in the Recycling Center. The Recycling Center is currently diverting about 10% of the waste it processes. It is anticipated that up to 15% of the waste going through the Recycling Center will be diverted during the short term and up to 30% during the long term. Refuse Service Areas A & B in the unincorporated northern San Joaquin County, and Self Haul waste from the Cities of Lodi, Stockton, Lathrop, Manteca, Ripon, and Escalon. Located at 17900 E. Harney Lane approximately 9 miles east of the City of Lodi, within the unincorporated area of north San Joaquin County. NONDISPOSAL FACILITY ELEMENT 4 III. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) REVIEW PRC Section 41735(a) exempts NDFE from the requirements of CEQA. Therefore, a CEQA review will not be performed on this NDFE. However, expansion or development of any new facilities discussed in this NDFE must go through appropriate CEQA review before expansion or development. NONDISPOSAL FACILITY ELEMENT 5
