That, Pursuant to the provisions of the hnztexa- ticrn of Uninhabited 'Territory Act of 1939, a petition signed by owners of s,11 of the land i n the hereinafter described texri tory, by area and by asucceed value as shown on the last equalized assessment roll of the County of San Joaquin, was filed with the Council of the City of 1,odi on December 17, 1959, requesting annexation of the hereinafter de,="ri.bed territory to said City. Section 2. ''hat the territory which the petitioners re-- uest he annexed to the City of Lodi and which said. City and i Council propose to annex, is situate in the County of Sart Joaquin, State of California, tiereby designated "Lutheran Church Addition," and described as follows: ti portion of the Northwest 'w,uarter of Section 11, '1'ownahio 3 North, Range 6 f✓'ast, Mount Diablo Base and Meridian, County of Sari Joaquin, State of Cali - Tornio., and more particularly described as follows: Beginning at the Northeast corner of the said Northwest quarter of Section 11; thence Westerly along the North line of said Quarter 695 feet to the true t,c.1nt of b�•innirig; thence South ()n 42' East and paral.ie1 to the East i.ine or said Quarter, 390 feet: thence due West and r,aral lel to the North line of acrid �rrter i0Y.5 feet to a uoint being 120 feet East of the East line of Hutchins -Sunset Park as -1- Tuan thereof tiled June 6, 195` in Volume 14, page 56, kook of Maps and Plats, San Joaquin County Records; thence North 27° 14' West a distarnce of 112.45 feet; theriee due West and paral 1 e l to the North line of Haid Quarter 70 feet to the Northeast corner of Lot 143 of said Hutchins- Sunset Park; thence North 0° 49' West along said east line of Hutchins -Sunset Park, which line is also a boundary line of the City of Lodi, ?YO feet to the North line of said 'Quarter; thence due East along the North 1L.ae of said Lluarter, a)so n City boundary line, 630.55 feet to the true point of' beginning. the parcel thus described contain_ irlyr 5.42 acres, more or less. California, lid in session duly assembled on Monday, December 14, !959, consider and approve the proposed annexation boundaries of said "Lutheran Church Addition," BY above described, and as submitted to said Commission by the proponents of said annexation. Sac tion 4. 'I'hat Wednesday, February 3, 1960, at the hour of Hs00 p.m. in the Council Chambers in the City Hall in the City 1' Lodi, County of San Joaquin, California, is hereby fi r.kd as the time and place when and where any person owning real rropert,y within the uninhabited territory above described an proposed to be annexed to they City of Lodi, and having any orhlent ions to the proposed annexation, nay apoear before the Council of the City of Lodi and show rause why such uninhabited territory should oot be `so annexed to the City of 'Lodi. The protest must be i n writing, may be filed at any time before -2- the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terns. Section 5. The City Clerk of the City of Lodi is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the "Lodi News -Sentinel", a newspaper of general circulation published in said City of Lodi, the city to which it is pro- posed to annex the aforesaid territory, said publication to be complete at least twenty (20) days prior to the date set for hearing. Section 6. In the event there is, upon the land proposed to be annexed to said City a structural improvement owned, being acquired or leased by a county fire protection district, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. rection 7. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
