That, pursuant to the provisions of the Annexation of Unintiab) ted Territory act of IYJY, a petition signed by owners less than one— fourth uS' tiatfdf the land in the hereinafter described territory, by area and by a.aseased value as shown on the last equalized assessment roll of the County of San Joaquin, was filed with the Council of the City of Lodi on November 4, 1959, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be annexed to the Cit,y of Lodi and which said City and i is Council propose to annex, is situate in the County of San Joaquin, State f Jalifornia, hereby designated "1?reeway Addition," and described as follows: A. portion of the west f Section 7, Township 3 North, Range 7 East, Mount Diablo Base and Meridian, and more particularly described as follows: bieginning at the Southwest curter of the ivc,rthwest ua.rtsr of Section 7, Township 3 north, Range 7 East, Mount Uiablo Base and Meridian; thence Easterly along the Quarter section line 309.62 feet to the true point t beginning; thence continuing along the said line 120 fejt to the Southeast r.orner of the parcel annexed to the City of Lori: ae the "Horton Addition" by Ordinance No. 40,, as filed on June 2, .91,7,0 in the San Joaquin County Records; thence Northerly along tha Eest line of the "Horton Addition", a City boundary line, 737 feet, more or less, to the North line of the parcel deeded to J. H. Hale and recorded in Volume 956, Page 217, Official iiecurds of an Joaquin County; thence Easterly along the Haid North line 1,045 feet, arse ur lean, to the East 'line of said parcel; thence Southerly along said East line 754.6 feet to the Quarter- Section line; thence Easterly along the Quarter- Section line 868 feet, more or less, to the Northeast corner of the Southwest ).uarter of Section 7; thence Southerly along the East line of the Southeast vcua.rter 668.68 feat to the South line of the Horth a} of' the North of the Southwest 'yua.rter; thence Westerly along the said South line 1,555.7 feet to the Northeast. corner of the parcel annexed to the City of Lodi &:%a the "Walnut Orchard Addition" by Ordinance No. 549, and recorded in the San Joaquin County Records on July 17, 1947; thence continuing Westerly along the North line of said Walnut Orchard Addition, also a City Boundary line, 516.93 feet to 5 c.,rusr of the present City Limits; thence North U° 541 West along the present City Limit line 667.5 rest to the true paint of beginning; trze property thus described containing 49.5 acres. more or less. That the County Boundary Commission of Sen Joaquin County, California, did in session duly e,s$emtl d on October 13, 1959, cunsidor and approve the proposed annexation boundaries of said "Freewa.y Addition," as above deaoribcd, and as submitted to said Oomn:lseion by the proponents of said annexation. 4. That Deoember16, ]95Q, at the hour of 8s00 p.m., in the Council Chambers in the City Hall in the City of Lodi, County of Sari Joaquin, California, is hereby fixed as the time and piaoe when. and where any pe'sm owning real property within the un-inhabite,i -2- territory above described arid proposed to be annexed to the City t L odi, and hiving any objections to ttie proposed annexation, may appear before the Council of the City of Lodi arid show cause why such uninhabited territory should not be so annexed to the City of Lodi. The protest must be in writing, may be filed at any time before ttie hour set for bearing objections to ttie proposed annexa- tion, and shall_ state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 5. The City Clerk of the City of Lodi is hereby authorized and Li.ireefed to cause a copy of this resolution to be published z -it past twice, but not oftener than once a week, in the "Lodi News- S'entinel ", a newspaper of general circulation published in said City of Lodi, the city to which it is proposed to annex the afore- s:a1,1 territory, and also in the "Stockton Record", a newspaper of general circulation published dutside the City of Lodi, but in the County of San Joaquin, California, the County in which is located the territory proposed to be annexed to the City of Lodi, said publication to be complete at least twenty (20) days prior to the date set for herring. 6. The said City ,leak is further authorized ant directed to cause written notice of such proposed arrriexutiou to be mailed to each person to whose land within the territory proposed to be annexed was assessed in the last equalized county assessment roll available on the dtste the above said proceedings were initiated, at ttie addresses shown on said assessment roll or known to said Clerk, and to any person who has filed his name and «ddr,ess and ttie designation of th i.ands .in wnicn be has an interest, either legal or equitable, wi Gtr $ +.ici Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 'r'• In the event there is, upon the land proposed to be annexed to Said. City, a structural immrovement owned, being acquired or leased - 3- by a county fire protection district, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to ttie governing body of such district, such notice to be sent not less than ten (:10) days before ttie first public hearing upon such proposed annexation. 6. The City Clerk is directed to cause written notice to be givers to such other persons as may be legally entitled thereto, in the manner required by law. Certified to be a full, true and correct copy of Hesolution Na 2273 of the City Council of the City of Lodi and that the same was passed and adopted in regular meeting of said City Council held November 4, 1959.
