HomeMy WebLinkAboutResolutions - No. 2239BESOLUTION NO. 2239 REPEALING RESOLUTION N0. 2216 AND RE- QUESTING A RELEASE OF PROTESTED TAXES WEEREAS, the City Council of the City of Lodi has heretofore adopted Resolution No. 2216, which resolution requested the County of San Joaquin to release to the City of Lodi the amcLuat of $3,353.41 representing the then estimated amount of taxes being held by the County of San Joaquin as a result of taxes being paid under protest by certain utility companies; and WHEREAS, one of the utility companies has withdrawn its protest and the exact amount of money being held by the County of San Joaquin is $2,490.90; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi as follows: 1_ That Resolution Iib 2216 of the City of Lodi is hereby rescinded. 2. `That the Board of Supervisors of the County of San Joaquin is hereby requested to release the aforesaid protested taxes being held to which the City is entitled in the gum of $21490.90. 3. That in the event a judgment should be entered in favor of the taxpayers or utilities in any suits brought by them based on their protests, the City of Lodi does hereby agree to pay to the County the sum so released to the City, said amount to be paid within the next fiscal year after the date of rendition of such judgment. Dated: June 10, 1959 This is to certify that the foregoing Resolution No. 2239 was duly and regularly adopted by a unanimous vote of the City Council of the City of Lodi at the regularly adjourned meeting of said City Council on Wednesday, June 10, 1959.
