T 11 TR$ R-3 L IKIT :D MULTIMN ?AMPLY SCSI IAL DISTRICT UMBRAS, under the provisions of that certain Act of the Legislature of the State of California entitled "Annexation of Uninhabited Territony Act of 1939", proceedings for the annexation to the City of Lodi of the territory hereinafter particularly described have been initiated by the filing of a petition for annexation to the City of Lodi of the territory hereinafter des- cribed by the owners of all of the land, both by area and assessed value, in said territory proposed to be annexed, and WHUR AS, the exterior boundaries of said territory described in said petition and which territory is contiguous to the limits of the City of Lodi, San Joaquin County, State of California, are described as follows: A 'motion of the Southwest Quarter of Section 2, Township 3 North, Range 6 East, mount Diablo Base and Meridian, San Joaquin County, California, and more particularly described as follows x 1egiadisli at the Soatheast corner of the said Quarter; thence Northerly along the East line of said Quarter 456 feet to its intersection with the extended South line of Walnut Street; thence Westerly along the South line of Walnut Street 264 feat to the true point or begin - gm; theme honti>Maing along the Smith line e' Walnut &treat, whiola line _ is also a bonndery line of the City of Lodi, 282.25 fest; themes South 0° 37k' East along the Nast line of the Lodi Alien High School property, also a City boundary, 192 feet, more or less; thence 1. kiasterly along a line parallel to the South line of Walnut Street, 282.25 feet; thence Horth O° 37#' Went a distance of 192 feet, more or less, to the true point of beginning; the property thus described. containing 1.24 acres, more or less. WHERSAS, the aforesaid petition further requests that the above described property be classified in the R-3 Limited Multiple Family Residential District, such classification to be effective coincident with the effective date of the annexation as provided in Section 4.2 of Ordinance No. 469 of the City of Lodi, and WHIOLr'A8, the aforesaid petition for annexation of the territory hereinbefore described to the City of Lodi, a municipal corporation. has been filed with and received by the Council of the City of Lodi, and WHWANg8, less than twelve registered voters reside within said territory thereby qualifying the territory for annexation under the proclaims of the Annexation of Uninhabited Territory Act of 1939, and id4FRMS, the boundaries of said territory have been approved by the County Boundary Commission of San Joaquin County as to their definiteness end csrteinty at a meeting of that body on April 27, 1959, Wow, therefors, Rx IT Rs$OLV*D, as follows: 1. That the City Coencil of the City of Lodi does by this resolution give notice of suck proposed annexation; does hereby give notice of its intention to zone said property R-3 Limited Multiple Family Residential to become effective coincident with the effective date of the annexation; des: hereby designate said territory as "Fischer Addition"; and further, does fix Wednesday, Jane 3, 1959, at the hour of 8:00 oaoloek p.m. at the City Council Chambers, City Hall, Lodi, California, as the day, hour and place when and where 2. any person owning real property within such territory so proposed to be annexed and having any objection to the proposed annexation may appear before the City Council and show cause why said territory should not be annexed. 2. That the Clerk of the City of Lodi be and she is hereby directed to cause a copy of this resolution to be published at least twice in the "Lodi flews -Sentinel", a newspaper printed, published and circulated in the City of Lodi, the municipal corporation to which it is proposed to annex the hereinbefore described territory, all in the tine, form and manner required by law, and that all owners of the property proposed for annexation having signed the petition for gush annexation, publication of a copy of this resolution outside of the City Limits of the City of Lodi is therefore waived in accor- dance with Section 35311 of the Government Code. 3. That at any time not later than the hour set for hearing objections to the proposed annexation, any► owner of property within the territory proposed to be annexed may file written protest against the proposed annexation; that such protests shall state the name or names of the owner or owners of the property affected thereby and the description and area of such property in general terms. Certified to be a fall, true and correct copy of Resolution No.4A14 of the City Council of the City of Lodi and that the sane was passed and adopted in regular meeting of said City -Council held May 6, 1959.
