ENDORSING RESOLUTION OF TH& CALIFORNIA MUNICIPAL
UTILITIES ASSOCIATION URGING PRaER ;NTIAL RIGHT
RR STATE AGENCIES AND NON-PROFIT ORGANIZATIONS
TO PURCHASE WAIT{ AND POWER FROM STATE PROJECTS
WHEREAS, the City Council of the City of Lodi has had
presented to it a proposed resolution, which is attached
hereto, of the California Municipal Utilities Association;
and
WIiEREAS, said resolution urges the Legislature of the
State of California to pass the legislation necessary to in-
corporate in State law an unequivocal provision giving State
agencies and non-profit organizations a preferential right
to purchase water and power from State constructed projects
at prices fixed and announced by the State; and
WHEREAS, the City Council of the City of Lodi wishes to
go on record as being in accord with said resolution;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Lodi does hereby endorse said resolution and does
hereby instruct its Superintendent of Utilities to vote "Aye"
thereon at the meeting of the California Municipal Utilities
Association being held on February 26, 1959.
I hereby certify that the foregoing resolution
was duly and regularly adopted and passed by the
City Council of the City of Lodi, California, at a
regularly adjourned meeting thereof held February
25, 1959 by the following vote:

RESOLUTION NO._
WHEREAS, the California Municipal Utilities Associa-
tion is composed of publicly owned bodies providing such essen-
tial utility services to the people of California as water and
power; and
WHEREAS, the State of California intends to construct
numerous water projects from which large quantities of water
and power will be available for distribution; and
WHEREAS, the present provision of State law relating
to preference in the purchase of water and power by public
agencies is unsatisfactory i n that it is confined to the
Central Valley Project and is based on "equal or equivalent
offers"; and
WHEREAS the Federal law has long contained a clear-
cut preference to public agencies in the purchase of water end
power developed by the Government; and
WHEREAS, the California Municipal Utilities Associa-
tion believes as a matter of polfcy public agencies and non-
profit organizations should have a preferential right to
distribute water and power developed by tho State with public
funds for the benefit of its citizens;
NOW, THEREFORE, BE IT RESOLVED that the California
Municipal Utilities Association urge the Legislature of the
State of California to pass the legislation necessaryto incor-
porate in State law an unequivocal provision giving State agencies

BE IT rumrrurtt RESOLVED that certified copies of this
resolution be sent by the Secretary to the Governor and to
appropriate cormttteas of the Senate and Assembly.
