HomeMy WebLinkAboutResolutions - No. 3398RESOLUTION NO. 3398 WITHDRAWING CERTAIN PROPERTY ANNEXED TO THE CITY OF LODI FROM THE WOODBRIDGE RURAL COUNTY FIRE PROTECTION DISTRICT WHEREAS, this City Council did by Resolution No. 3379, effective May 27, 1970, approve the annexation of that certain real property, contiguous to the City of Lodi, designated as "South Stockton Street No. 2 Addition"; and WHEREAS, there is on file in the office of the City Clerk of the City of Lodi the Certificate of the Secretary of State of the State of California, executed by said Secretary of State on June 5, 1970, referring to said Resolution No. 3379, and the annexation of the real property described therein: and WHEREAS, the affidavit of the City Clerk of the City of Lodi certifying to the annexation of said "South Stockton Street No. 2 Addition" in accordance with law was filed with the County Recorder of San Joaquin County on June 22, 1970; and WHEREAS, it is the desire of this City Council that that portion of said property designated as "South Stockton Street No. 2 Addition which lies within the Woodbridge Rural County Fire Protection District be withdrawn from said District, now, therefore, BE IT RESOLVED by the City Council of the City of Lodi as follows: That that certain real property, lying within the said "South Stockton Street No. 2 Addition" and particularly described as follows, to wit: A portion of the Southeast one-quarter (SE 114) of Section twelve (12), Township three (3) North, Range six (6) East, Mount Diablo Base and Meridian, and a portion of the Northeast one-quarter (NE 114) of Section thirteen (13), Township three (3) North, Range six (6) East, Mount Diablo Base and Meridian. Beginning at a point which is common to a parcel of land annexed to the City of Lodi as the "Academy Addition" as described in City of Lodi Ordinance No. 229 as adopted on the 4th day of January, 1937, and a parcel of land annexed to the City of Lodi as the "Stockton Street Addition" as described in Lodi City Council Resolution No. 2971 and adopted on the 3rd day of August, 1966, which point lies North 0" 5 112' West 25.03 feet and North 87" 06' East 70.00 feet from the Northwest coerner of said Northeast one-quarter of Section 13. (as shown on map o survey filed for record in Vol. 5, Page 231, Record of Surveys San Joaquin County Records), said point of beginning also being on the north right-of-way line of State Highway Sign Route 12 (50 feet wide), also known as liettleznan Lane; thence South 0' 5 112' East. crossing said State Highway, along the east side of said "Stockton Street Addition" 150.03 feet to the southeast corner of said addition; thence South 87 06' West along the south line of said addition to 49. 98 feet to a point on the East right-of-way line of Stockton Street (40 feet wide); 3395 - thence South 0" 5 112' West crossing said State Highway 200.03 feet to a point on the south line of said "Academy Addition;" thence South 87' 06' West along the south line of said "Academy Addition" 10. 00 feet to the point of beginning. annexed to the City of Lodi by Council Resolution No. 3379, be and it is hereby declared to be withdrawn from the Woodbridge Rural County Fire Protection District. Dated: July 1, 1970 CERTIFIED to be a full, true and correct copy of Resolution No. 3398 passed and adopted by the City Council of the City of Lodi in regular meeting held July 1, 1770 by the following vote: AYES: Councilmen - Katnich, Kirsten, Ehrhardt, Hughes, and Schaffer NOES: Councilmen - None
