RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION
TO CITY OF LODI OF UNINHABITED TERRITORY DESCRIBED
HEREIN AND DESIGNATED "PICCOLO ADDITION, " AND
GIVING NOTICE OF TIME AND PLACE FOR HEARING
PROTESTS THERETO
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LODI:
1. That, pursuant to the provisions of the Annexation of Uninhabited
Territory Act of 1939, a petition signed by owners of not less than one-fourth
of the land in the hereinafter described territory, by area and by assessed
value as shown on the last equalized assessment roll of the County of San
Joaquin, was filed with the Council of the City of Lodi on January 7, 1970
requesting annexation of the hereinafter described territory to said City.
2. That the territory which the petitioners request he annexed to the
City of Lodi and which said City and its Council propose to annex is situate
in the County of San Joaquin, State of California, hereby designated
"Piccolo Addition, " and described as follows:
A portion of the Southeast one-quarter (SEI/4) cf Section six
(6), Township three (3) North, Range seven (7) East, Mount Diablo
Base and Meridian, and more particularly described as follows:
Commencing at the Southwest corner of the Southeast one-
quarter of said Section 6, being on the north right of way line of
the Central California Traction Company Railroad right of way
(100 feet wide), being a point on the existing City Limits line of the
City of Lodi, being also the southwest corner of Lot 9 as shown on
MAP NO. 3 OF LIVE OAK COLONY, filed for record February 28,
1889 in Book of Official Maps and Plats, Volume 1, page 75, San
Joaquin County Records; thence leaving said North line of Central
California Traction Company Railroad right of way and said City
Limits line, Northerly along the west line of said Southeast
one-quarter of said Section 6, being the west line of Lots 9, 8,
7, 6, 5 and 4 as shown on said MAP NO. 3 OF LIVE OAK COLONY,
a distance of 796.3 feet to intersection with the southwest corner of
Lot 3 as shown on said MAP NO. 3 OF LIVE OAK COLONY, being
a point on the existing City Limits line of said City of Lodi, as
described by City of Lodi Ordinance No. 616 (75th Addition) approved
by the City Council of the City of Lodi, May 21, 1958, and City of
Lodi Resolution No. 3270 (Bischel Addition) approved by the City
Council of the City of Lodi, May 21, 1969, being also the TRUE
POINT OF BEGINNING: thence leaving said west line of said Southeast
one-quarter of said Section 6, Easterly, along the south line of
said Lot 3, being along said City Limits line, a distance of 343. 8
feet to intersection with the west line of Lot 10 as shown on said
MAP NO. 3 OF LIVE OAK COLONY: thence leaving said City Limits
line, Northerly, along said west line of Lot 10, being also along the
east line of Lots 3, 2 and 1 as shown an said MAP NO. 3 OF LIVE
OAK COLONY, a distance of 407. 3 feet to intersection with the
centerline of East Pine Street (60 feet wide): thence Westerly, along
said centerline of East Pine Street a distance of 351. 3 feet to inter-
section with aforesaid west line of said Southeast one-quarter of said
Section 6, being a point on said City Limits line as described by City
of Lodi Ordinance No. 261 (Eleventh Addition) approved by the City
Council of the City of Lodi, December 20, 1939 and aforesaid City of
Lodi Ordinance No. 616; thence leaving said centerline of East Pine
Street, Southerly, along said west line of said Southeast one-quarter

of said Section 6, being along said City Limits line, being also
the west line of said Lots 1, 2 and 3 as shown on said MAP NO. 3
OF LIVE OAK COLONY a distance of 407.8 feet, more or less, to
the true paint of beginning, the area thus described containing 3. 2
acres, more or less.
3. That the Local Agency Formation Commission of San Joaquin
County, California, did in session duly assembled on Friday, December 19,
1969, consider and approve the proposed annexation of said "Piccolo
Addition," as above described, and as submitted to said Commission by the
proponents of said annexation.
4. That Wednesday, March 4, 1970, at the hour of 8.00 p. m, in the
Council Chambers in the City Hall in the City of Lodi, County of San Joaquin,
California, is hereby fixed as the time and the place when and where any person
owning real property within the uninhabited territory above described and
proposed to be annexed to the City of Lodi, and having any objections to the
proposed annexation, may appear before the Council of the City of Lodi and
show cause why such uninhabited territory should not be so annexed to the
City of Lodi. The protest must be in writing, may be filed at any time before
the hour set for hearing objections to the proposed annexation, and shall state
the name or names of the owner or owners of property affected and the
description and area of such property, in general terms.
5. The City Clerk of the City of Lodi is hereby authorized and directed
to cause a copy of this resolution to be published at least twice, but not
oftener than once a week, in the "Lodi News Sentinel, " a newspaper of
general circulation published in said City of Lodi, the city to which it is
proposed to annex the aforesaid territory, and also in the "Stockton Record, "

a newspaper of general circulation published outside the City of Lodi,
but in the County of San Joaquin, California, the county in which is located
the territory proposed to be annexed to the City of Lodi, said publication to
be complete at least twenty days prior to the date set for hearing.
6. The said City Clerk is further authorized and directed to cause
written notice of such proposed annexation to be mailed to each person to
whom land within the territory proposed to be annexed was assessed in the
last equalized county assessment roll available on the date the above said
proceedings were initiated, at the addressed shown on said assessment roll
or known to said Clerk, and to any person who has filed his name and address
and the designation of the lands in Whch he has an interest, either legal or
equitable, with said Clerk, such notice to be given not less than twenty days
before the first public hearing on the proposed annexation.
i. In the event there is, upon the land proposed to be annexed to
said City, a structural improvement owned, being acquired or leased by a
county fire protection district, the City Clerk is directed to cause written
notice of such proposed annexation to be mailed to the governing body of such
district, such notice to be sent not less than ten days before the first public
hearing upon such proposed annexation.
8. The City Clerk is directed to cause written notice to be given to
such other persons as may be legally entitled thereto, in the manner
required by law.
