COMMUNICATION AGENDA TITLE: Authorize Community Development Director to Submit Waste Tire Facility Enforcement Grant Application to State Integrated Waste Management Board MEETING DATE: March 17, 1999 PREPARED BY: Community Development Director RECOMMENDED ACTION: That the City Council adopt the attached resolution authorizing the Community Development Director to Submit the Waste Tire Facility Enforcement Grant Application to State Integrated Waste Management Board. BACKGROUND INFORMATION: The State Integrated Waste Management Board is offering grant moneys to cities and counties as Local Enforcement Agencies to conduct waste fire facility (WTF) inspections of those facilities that accept or store more than 500 waste tires at one location. It is the intent of this program to implement an effective inspection and compliance program at the local level which will provide guidance to facility operators, and if necessary, take the initial enforcement actions to mitigate threats to the public health, safety and the environment. As the number of commercial facilities which accept or store more than 500 used or waste tires within this jurisdiction increases, the ability of the State Waste Management Board's Enforcement Agency to actively monitor each site for compliance with applicable regulations will decrease. Eligible project expenses include both personnel expenses and enforcement activity expenses directly related to the inspection/compliance and/or surveillance of waste tire facilities. Grant Program RESOLUTION AUTHORIZING SUBMITTAL OF WASTE TIRE ENFORCEMENT GRANT APPLICATION (Sample/Please Retype) WHEREAS, funds allocated and are available from the California Integrated Waste Management Board for grants to solid waste Local Enforcement Agencies (LEA) and cities and counties with regulatory authority within the city and county government to perform enforcement/compliance and/or surveillance activities at waste tire facilities: and WHEREAS, the applicant demonstrates it has sufficient staff resources, technical expertise, and/or experience with similar projects to carry out the proposed program: NOW, THEREFORE, be it resolved that the (governing body of the local jurisdiction) authorizes the submittal of an application to the California Integrated Waste Management Board for a Waste Tire Enforcement Grant. The (title of official) of the (name of jurisdiction) is hereby authorized and empowered to execute in the name of (name of jurisdiction) all necessary applications, contracts, agreements and amendments for the purposes of securing grant funds and to implement and carry out the purposes specified in the application. NOW, THEREFORE, BE IT RESOLVED, that the Lodi City Council does hereby authorize the submittal of an application to the California Integrated Waste Management Board for a Waste Tire Enforcement Grant; and BE IT FURTHER RESOLVED, that the Community Development Director of the City of Lodi is hereby authorized and empowered to execute in the name of the City of Lodi all necessary applications, contracts, agreements and amendments for the purposes of securing grant funds and to implement and carry out the purposes specified in the application.
