HomeMy WebLinkAboutResolutions - No. 3270c RESOLUTION NO. 3270 A RESOLUTION APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "BISCHEL ADDITION," TO THE CITY OF LODI BE IT RESOLVED by the City Council of the City of Lodi: WHEREAS, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by all the owners of certain uninhabited territory was filed with the Council of the City of Lodi on May 7, 1969, request- ing annexation of said territory to the City of Lodi; and WHEREAS, on the 7th day of May, 1969, the City Council of the City of Lodi did pass and adopt Resolution No. 3258 giving notice of the proposal to annex said uninhabited territory to the City of Lodi, said territory being therein designated as "Bischel Addition, " said Resolution describing the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution No. 3258 did contain a notice of the day, hour and place when and where the Council of the City would hear protests made by any person owning real property within the City of Lodi but not owning real property within the territory proposed to be annexed, the time of said hearing being not more than thirty days from the date of passage of said Resolution; and WHEREAS, said Resolution was duly published in accordance with law; and WHEREAS, on the 21st day of May, 1969, at the hour of 8:00 p. m. in the Council Chambers in the City Hall of the City of Lodi, County of San Joaquin, State of California, said time and place being the day, hour and place fixed in said Resolution No. 3258 for hearing protests to the said annexation, the said City Council did conduct said hearing and did determine that no protests to said annexation had been made; and WHEREAS, said territory is continguous to the City of Lodi, and is unin- habited territory in the County of San Joaquin; NOW, THEREFORE, the said Council of the City of Lodi does hereby approve the annexation of the territory hereinafter described to the City of Lodi, and does hereby further resolve that the said territory be and is hereby annexed to the City of Lodi. That said territory, the annexation of which to the City of Lodi is herein approved, is all that territory situate in the County of San Joaquin, State of California, more particularly described as follows: A portion of the Southeast one-quarter (SE 1/4) of Section six (6) Township three (3)North, Range seven (7), East Mount Diablo.base and Meridian, and more particularly described as follows: -1- f Beginning at the Southwest corner of the Southeast one-quarter of said Section 6, being on the north right of way line of the Central California Traction Company Railroad right of way (100 feet wide), being also on the City Limits line of the City of Lodi as described by City of Lodi Ordinance No, 616 (75th Addition) approved by the City Council of the City of Lodi, May 21, 1958 and Ordinance No. 837 (Super Mold Addition) certified by the Secretary of State, May 23, 1967, also being the southwest corner of Lot 9 as shown on MAP NO. 3 OF LIVE OAK COLONY filed for record February 28, 1889 in Book of Official Maps and Plats. Volume 1, page 75, San Joaquin County Records; thence leaving said north line of Central California Traction Company Railroad right of way, Northerly along said City Limits line, being the west line of said Southeast one-quarter of said Section 6 and the west line of Lots 9, 8, 7, 6, 5 and 4. as shown on said MAP NO. 3 OF LIVE OAK COLONY, a distance of 796. 3 feet to intersection with the south- west corner of Lot 3 as shown on said LIVE OAK COLONY; thence leaving said City Limits line, Easterly along the south line of said Lot 3, a distance of 343.8 feet to intersection with the west line of Lot 10 as shown on said MAP NO. 3 OF LIVE OAK COLONY; thence Southerly along said west line of Lot 10, being the east line of aforesaid Lots 4, 5, 6, 7, 8 and 9, as shown on said LIVE OAK COLONY, a distance of 812.7 feet to intersection with the north right of way line of said Central California Traction Company Railroad right of way, being the south line of said Southeast one-quarter of said Section 6; thence Westerly along said north Railroad right of way line, being said south line of said South- east One-quarter, also being the south line of aforesaid Lot 9 as shown on said MAP NO. 3 OF LIVE OAK COLONY, a distance of 326 feet, more or less, to the point of beginning. Containing 6.2 acres, more or less.
