HomeMy WebLinkAboutResolutions - No. 2970RES OLUT I Obi NO. 2970 A RESOLUi'ION APPROVING THE AN EY-ITION 0: CERTAIN UN:NF.ABITED TERRITORY, DESIGNATED "MILLS ESTATE ADDITIOPT," TO THE CITY OF LODI BE IT RESOLVED by the City Council of the City of Lodi: , T,F HEREAS, pursuant to the provisions of the vnnexat_on of Uninhabited Territory Act of 1939, a petition signed by all the owners of cartain uninhabited territory was filed with the Council of the City of Lodi on July 20, 1966, requesting annexation of said territory to the City of Lodi; and wr_mnAS, on the 20th day of July, 1966, the City Council of the City of Lodi did pass and adopt Resolution No. 2968 giving notice of the proposal to annex said uninhabited territory to the City of Lodi, said territory being therein designated as "Mills Estate Addition," said Resolution describing the boundaries of the territory proposed to be annexed; and 'nKEREAS, said Resolution To. 2968 did contain a notice of the day, hour ani place whet; and where the Council of the City of Lodi would hear protests made by any person ou-n-1119 real property with?? the City of Lodi but not owning real property within t:r'e territory proposed to be annexed, the time of said hearing being not more than thirty days from the date of passage of said Reso- lution; and :;iHEREAS, said Resolution was duly published in accordance Frith law; and 'WHEREAS, on the 3rd day of August, 1966, at the hour of 8:00 p. -n. in the Council Chambers in the City Hall of the CitY of Lodi, County of San Joaquin, State of California, said time and place being the day, hour and place fixed in said Resolution No. 2698 for hearing protests to the said annexation, the said City Council did conduct said hearing and did deternine that no protests to said annexation had been made; and 1. WFEE—RE-0, said territory is contiguous to the City of Lodi, and is uninhabited territory in the County of San Joaquin; NOW, TTEREFORE, the said Council of the City of Lodi does hereby approve the annexation of the territory hereinafter des- cribed to the City of Lodi, and does hereby further resolve that the said territory be and is hereby annexed to the City of Lodi. That said territory, the annexation of which to the City of 'Lodi is herein approved, is all that territory situate in the County of San Joaquin, State of California, more particularly described as follows: d portion of the East Half of Section 3, I'mmship 3 _Torth, Range 6 East, Mount Diablo Base and Meridian, and more particularly described as follows: Beginning at the Northeast corner of the parcel of land annexed to the City of Lodi as the "Ray Addition" as described in City of Lodi Ordinance No. 647; thence North 000 444 West along the East line of said Section 3, also being an existing City Limits line, 976.30 fest to tte southernmost line of the parcel of land annexed to the City of Lodi as the "Ginocchio Addition" as described in City of Lodi Ordinance No. 737; thence South 890 51' 30" ledest along said southernmost line and its Westerly extension, said Westerly extension also being an existing City Limits line, 1523.2 feet to the West line of Rainier Drive, as shown on Map of Survey filed for record in Vol- une 14, page 190, Book of Surveys, San Joaquin County Records; thence leaving said existing City Limits line, South 000 361 30" East 415.30 feet; thence South 010 581 10" East 561.25 feet; thence North 890 511 30" East 1°2.0 feet to the Northwest corner of ELMHAVEN, the map or plat of which is filed for record in Volume 17, page 71, Book 2. of Yaps and Plats, San Joaquin County Records; thence continue North 890 51' 30" East along the North line of said EL'^31AVEN and along the North_ line of SON -RAY MINOR, the map or plat of which is filed in Volume 16, page 28, Book of Maps and Plats, San Joaquin County Records, said _North line of SON -RAY M -,NOR also beinz an existing City Linits line, a distance of 1320.0 feet to the point of beginning; the area thus described containing 34.07 acres, more or less.
