HomeMy WebLinkAboutResolutions - No. 2963RESOLUTION NO. 2963 A RFS OLUT I ON APPROVING TEE ANNEXATION OF CERTAIN MrINHABITED TERRITORY, DESIGNATED "VOGEL ADDITION" TO THE CITY CF LODI BE IT RESOLVED by the City Council of the City of Lodi: WHEREAS, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by all the 0,�Mers of certain uninhabited territory was filed with the Council of the City of Lodi on July 6, 1966, requesting annexation of said territory to the City of Lodi; and WHEREAS, on the 6th day of July, 1966, the City Council of the City of Lodi did pass and adopt Resolution No. 2954 giving notice of the proposal to annex said uninhabited territory to the City of Lodi, said territory being therein designated as "Vogel Addition," said Resolution describing the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution No. 2954 did contain a notice of the day, hour and place when and where the Council of the City would hear protests made by any person owning real property within the City of Lodi but not owning real property within the territory proposed to be annexed, the time of said hearing being not more than thirty days from the date of passage of said Resolution; and WHEREAS, said Resolution was duly published in accordance with law; and VHEREAS, on the 20th day of July, 1966, at the hour of 8:00 p.m. in the Council Chambers in the City Hall of the City of Lodi, County of San Joaquin, State of California, said time and place being the day, hour and place fixed in said Resolution No. 2954 for hearing protests to the said annexation, the said City Council did conduct said hearing and did determine that no protests to said annexation had been made; and WHEREAS, said territory is contiguous to the City of Lodi, and is uninhabited territory in the County of San Joaquin; 1. NOW, TSrMEF01E, the said Council of the City of Lodi does hereby approve the annexation of the territory hereinafter described to the City of Lodi, ana does hereby further resolve that the said territory be and is hereby annexed to the City of Lodi. That said territory, the annexation of which to the City of Lodi is herein approved, is all that territory situate in the County of San Joaquin, State or' California, more particularly described as follows: A portion of the Northeast Quarter of Section 7, Township 3 North, Range 7 East, Yount Diablo Base and Meridian, and more particularly described as follows: Beginning at the Southeast corner of the Southwest Quarter of said Northeast Quarter, said point being also a corner of the existing City Limits; thence Easterly along the South line of said Northeast Quarter to the Southeast corner thereof; thence Northerly along the East line of said Northeast Quarter t o the North line of the South one-half(Si) of said Northeast one-quarter of Section 7, baing the North line of the parcel of land conveyed as Pa.RCEL IV to Hoyt Heater Company, bX deed recorded Yay 12, 1965 in Book 2944, Page 52, Official Records; San Joaquin County Records; thence Westerly along said North line of the South one-half(S�) of the Northeast one-quarter (NE -4) of Section 7, being along the North line of said PAROL IV and along the North line of P,�RCEL II of said deed to Hoyt Heater Companyto the Northeast corner of the parcel of land conveyed to Norman Gertmenian, et ux, by deed recorded FIareh 26, 1948 in Volime 1133, Page 88, Official Records, San Joae,uin County Records; thence South along the East line of said Gertmenian 2. parcel 396.8 feet; thence South 86° 441 East, 19 feet; thence South 189.7 feet to the Worth line of the tract of land annexed to the City of Lodi as the "Lone Oak Addi- tion," described in City of Lodi Ordinance No. 796, thence Easterly along the North line of said "Lone Oak Addition" to the Northeast corner thereof; thence Southerly along the East line of said "Lone Oak Addition" to the point of beginning; the area thus described containing 56.9 acres, more or less.
