HomeMy WebLinkAboutResolutions - No. 2962RESOLUTION NO. 2962 A RES OL UT I_ ON APPROVING TEE ANNEXATION CF CERTAIN UNINHABITED TERRITORY, DESIGNATED "MELli,;rr ADDITION," TO Thi CITY CF LODI BE IT RESOLVED by the City Council of the City of Lodi: WEEREAS, pursuant to the provisions of the annexation of Uninhabited Territory Act of 1939, a petition signed by the own.er of certain un?thabited territory was filed with the Council of the City of Lodi on July 6, 1966, requesting annexation of said territory to the City of Lodi; and WHEREAS, on the 6th day of July, 1966, the City Council of the City of iodi did pass and adopt Resolution "lo. 2955 giving notice of the proposal t o annex said uninhabited territory t o the City of Lodi, said territory being therein designated as "Melhari: Addition," said Resolution describing the boundaries of the terri- tory proposed to be annexed; and WHEREAS, said Resolution No. 2955 dj.d contain a notice of the day, hour and place when and where the Council of the City would hear protests made by any person owning real property within the City of Lodi but not owning real property within the territory proposed to be annexed, the time of said hearing being not more than thirty days from the date of passage of said Resolution; and WHEREAS, said Resolution was duly published in accordance with law; and WHEREAS, on the 20th day of July, 1966, at the hour of 8.00 p.m. in the Council Chambers in the City Ra11 of the City of Lodi, County of San Joaquin, State of California, said time and place being the day, hour and place fixed in said Resolution No. 2955 for hearing protests to the said annexation, the said City Council did conduct said hearing and did determine that no protests to said annexation had been made; and 1. WHEREAS, said territory is contiguous to the City of Lodi, and is uninhabited territory in the County of San Joaquin; Pio', THEREFORE, the said Council of the City of Lodi does hereby approve the annexation of the territory hereinafter des- cribed to the City of Lodi, and does hereby further resolve that the said territory be and is hereby annexed to the City of Lodi. That said territory, the annexation of which to the City of Lodi is herein approved, is all that territory situate in the County of San Joaauin, State of California, more particularly described as follows: A. portion of the Northwest Quarter of Section 13, Town- ship 3 North, Range 6 East, Mount Diablo Base and Meridian, and more particularly described as follows: Beginning at a point on the West line of the Southern Pacific Railroad Company right of way, which line is also tho East line of the parcel of land annexed to the City of Lodi as the "Lowe's Addition" and described in City of Lodi Ordinance No. 467, said point being 1312.41 feet North- erly, as neasured along said right of way line, from the South line of said Northwest Quarter; thence Easterly and parallel to said South line of the Northwest Quarter 1027.09 feet, more or less, to the West line of Stockton Street (40 feet wide); thence Northerly along said West line of Stockton Street, which line is 20 feet West of and parallel to the East line of said Northwest Quarter, a distance of 709.50 feet; thence Westerly and parallel to the South line. of said Morthwest Quarter975.61 feet, more or less, to the East line of said "Lowe's Addition;" thence Southerly along said East line of "Lowe's Addition," being also an existing City Limits line, 711.433 feet more or less, to the point of beginning; the area thus described contain- ing 16.3 acres, more or less.
