HomeMy WebLinkAboutResolutions - No. 2870RZSOL€TTION NO. 2870 5UPPLaM�TAL SOLUTION AUTRORIZING THE CITY MAMA= TO FILE APPLICATION FUR GRANT TO ACQUIRc, OPEN -SPACE LAND WHEREAS, Title VII of the Rousing Act of 1961 provides for the making of grants by the Housing and Home Finance Administrator to states anti local public bodies to assist them in the acquisition of permanent interests in land for open -space purposes -rhere such acquisition is deemed essential to the proper long-range development and welfare of urban areas in accordance With plans for the allocation of land to such purposes; and WHERE,,�,S, the City of Lodi desires to acquire Fee Interest to certain land known as Park -Retention Basin B-1, which land, in accordance with the Master Plan far the Development of Storm Water Collection and Disposal Facilities adopted by the City Council of the City of Lodi, is to be held and used for permanent open -space land as park and storm water retention basin: and WHEREAS, Title VI of the Civil Rights Act of 1964, and the regulations of the Rousing and Home Finance Agency effectuating that Title, provide that no person shall be discriminated against because of race, color, or national origin in the use of the land proposed to be acquired; and WHIaEAS, it is estimated that the total consideration to be paid for the acquisition of said interest rill be 597,027.20; NOW, THERErOR.E, 33 IT RESOLVED BY THE CITY COUNCIL OF 'PH CITY OF LODI AS FOLLOWS: 1. That an application be made to the Housing and Home Finance Agency for a grant in an amount authorized by Title VII of the Housing Act of 1961, which amount is presently estimated to be $19,405.44, and that the City of Ladi will pay the balance of the consideration for the acquisition of such interest and the total of all related eosts from other funds available to it. 2. That the City Manager is hereby authorized and directed to execute and to file such application pith the Housing and Home Finance Agency, to Provide additional infor„ation and to furnish such documents as may be re- ,luired by said Agency, to execute such contracts as are required by said Agency, and to act as the authorized correspondent of the City of Lodi. 3. That the proposed acquisition is in accordance with the Master Flan for the Development of Storm Water Collection and Disposalraoilities adopted by the City Council for the preservation of permanent open -space land, and that, should said grant be made, the City of Lodi will retain said land for the use designated in said application and anproy,'d by the Housing and Home Finance Agency. 4. That the United States of America and the Housing and Home Finance Administrator be, and they hereby are, assured of full compliance by the City of Lodi with regulations of the Ho•.zsing and Home Finance Agency effect- ua;.in; Title VI of the Civil 3ight6 Act of 1964.
