HomeMy WebLinkAboutResolutions - No. 2867RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF LODI OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DFS IGNATED "KUNDERT ADDITION'," AND GIVING NOTICE OF TIME AND PLACE FOR BEARING PROTFSTS THERETO BE IT RESOLVED BY THE COUNCIL CF THE CITY CF LODI: 1. That pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of all of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assess- ment roll of the County of San Joaquin, was filed with the Council of the City of Lodi on October 6, 1965, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be annexed to the City of Lodi and which said City and its Council propose to annex, is situate in the County of San Joaquin, State of California, hereby designated "Kundert Addition," and described as follows: A portion of the Northeast Quarter of Section 13, Town- ship 3 North, Range 6 East, Mount Diablo Base and Meridian, and a portion of the Northwest Quarter of Section 18, Township 3 North, Range 7 East, Mount Diablo Base and Meridian, and more particularly described as follows: Beginning at the Southwest corner of the tract of land annexed to the City of Lodi as the "Kettelman Addition," described in City of Lodi Resolution Na 2802; thence Southerly along the West line of Cherokee Lane (formerly State Highway X -SJ -4C), being also a City Limit line, 1182.2 feet, more or less, to the Southeast corner of the tract of land annexed to the City of Lodi as the "42nd Addition," described in City of Lodi Ordinance NO- 454; thence Westerly along the South line of said "42nd Addition," being also a City Limit line, 200 feet to the East line of the tract of land annexed to the 1. City of Lodi as the "Rathan Addition," described in City of Lodi Ordinance Na 704; thence Southerly along the East line of said "Nathan Addition," being also a City Limit iine, 50 feet, more or less, to the Southwest corner of the parcel con- veyed to Eenry Gansch by deed recorded August ll, 1955 in Vol.. 1778, page 599, San Joaquin County Records; thence continuing along the boundary of said "Nathan Addition" Westerly along a line parallel to the North line of Almond Drive, being also a City Limit line, a distance of 20.0 feet; thence Southerly along a line parallel to the West line of said Cherokee Lane, being also a City Limit line, 521.56 feet to the North line of Almond Drive; thence leaving the City Limit line, Easterly along the North line of said Almond Drive and its Easterly extension, 380.0 feet, more or less, to the East line of said Cherokee Lane; thence Northerly along said East line 1725 feet, more or less, to the North line of said Section 18; thence North 870 39' 51" West along said North line, being also a City Limit line, 113.2 feet, more or less, to the Northwest corner of said Section 1B; thence South 860 31' West along the North line of said Section 13, being also a City Limit line, 46.8 feet, more or less, to the point of beginning; the area thus described containing 9.3 acres, more or less. 3. That the County Boundary Commission of San Joaquin County, California, did in session duly assembled on Tuesday, September 14, 1965, consider and approve the proposed annexation boundaries of said "Kandert Addition," as above described, and as submitted to said Commission by the proponents of said annexa- tion. '+- That the Local Agency Formation Commission of San Joaquin County, California, did in session duly assembled on Friday, September 17, 1965, consider and approve the proposed annexation of said "Kundert Addition," as above described, and `IA as submitted to said Commission by the proponents of said annexation. 5. That Wednesday, October 20, 1965, at the hour of 8:00 p.m., in the Council Chambers in the City Hall in the City of Lodi, County of San Joaquin, California, is hereby fixed as the time and place when and where any person owning real property within the City of Lodi, but not owning real property within the uninhabited territory above described and proposed to be annexed to the City of Lodi, and having any objections to the proposed annexation, may appear before the Council of the City of Lodi and show cause why such uninhabited territory should not be so annexed to the City of Lodi. The protest must be in writing, may be filed at any time before the hour set for hearing objec- tions to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the des- cription and area of such property, in general terms. 6. The City Clerk of the City of Lodi is hereby authorized and directed to cause a copy of this resolution to be published at least once in the Lodi Ne"s Sentinel, a newspaper of general circulation published in said City of Lodi, the city to which it is proposed to annex the aforesaid territory, said publication to be complete at least four days prior to the date set for hearing.
