That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of not less than ane - fourth of the land in the hereinafter described territory, by area and by assessed valuation as shown on the last equalized assessment roll of the County of San Joaquin, was filed with the Council of the City of Lodi on July 7, 1965, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be annexed to the City of Lodi and which said City and its Council propose to annex. is situate in the County of San Joaquin, State of California, hereby designated "Hutchins Estate Addition," and described a5 follows A portion of the Southwest Quarter of Section 2, Township 3 North, Range 6 East, Mount Diablo Base and Meridian and a pox tion of the Northwest Quarter of Section 11, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, and more particu- larly described as follows: Beginning at a point on the North line of said Northwest Quarter of Section 11, which point is 150 feet Westerly of the Northeast corner of said Quarter and which point is also a corner of the existing City Limits; thence Westerly along the North line of said Quarter 114 feet, more or less, to the Southwest corner of the parcel of land annexed to the City of Lodi as the "Harrison Addition," as described in City of Lodi Resolution No. 2321; thence N 00 3Vz' 4V along the West line of said Harrison Addition, being also an existing City Limit line, 264 feet, rote or less, to the Southeast corner of the parcel of land annexed to the City of Lodi as the "Fischer Addition," as described in City of Lodi Ordinance No. 648; thence Westerly along the South line of said "Fischez Addition," being also an existing City Limit line, 117.25 feet to the Northeast corner of the parcel of land annexed to the City of Lodi as the "Marchese Addition," as described in City of Lodi Ordinance No. 676; thence Southerly along the East line of said "Maxchese Addition," being also an existing City Limit line, 264.0 feet to the Southwest corner thereof; thence Westerly along the South line of said "Mazchese Addition" and its Westerly projection, being also an existing City Limit line, 313.75 feet to the Northeast corner of the parcel of land annexed to the City of Lodi as the "Lutheran Church Addition," as described in City of Lodi Ordinance No. 667; thence South 00 42' East along the East line of said "Lutheran Church Addition,', being also an existing City Limit line, 390 feet to the Southeast corner thereof; thence West along the aottth line of said "Lutheran Church Addition," being also an existing City Limit line, 509.5 feet; thence North 270 141 West, being also an existing City Limit line, 112.45 feet, thence West 70 feet to the Northeast corner of Lot 143 of Hutchins Sunset Park, a subdivision, as shown on map filed for record June 6, 1955 in Volume 14, page 56, Book of Maps and Plats, San Joaquin County Records; thence South Oo 49' 30" East along the East line of said Hutchins Sunset Park, being also an existing City Limits line, 1030 feet, true or less, to the Southeast corner of the parcel of land annexed to the City of Lodi as the "Western Addition," as described in city of Lodi Ordinance No. 528; thence West along the South line of said Western Addition," being also an existing City Limits line, 1320.0 feet to the intersection of the same with the West line of the said Northwest Quarter of Section 11; thence South 00 49' 30" East along the West line of said Quarter 1320 feet, more or less, to the Northwest corner of the parcel of land annexed to the City of Lodi as the "Owens Addition," as described in City of Lodi Resolution No. 2736; thence South 890 07' East along the North line of said 1'Owens Addition," being also an existing City Limits line, 1320 feet, more or less, to the Southwest corner of the parcel of land annexed to the City of Lodi as the "Chiappe Addition," as described in City of Ladi Ordinance No. 699; thence North 00 0"1 K a s t along the West line of said "Chiappe Addition," being also an existing City Limit line, 409.63 feet to the Northwest corner of Vista Ray, a subdivision, as shown on map filed for record July 31, 1964, in Vohune 17, page 54, Book of Maps and Plats, San Joaquin County Records; thence South 890 07' East along the North line of said Vista Ray Subdivision, being also an existing City Limits line, 957.31 feet to the Southwest corner of the parcel deeded to Anthony Herbert Chiappe by a decree of final distribution recorded on October 9, 1959 in Book 2225, page 216, a an Joaquin County Records; thence N Qo 06%' East along the West line of said parcel deeded to Anthony Harbezt Chiappe, being also an existing City Limits line, 409.63 feet to the northwest corner of the property deeded to Anthony Chiappe and Gladys Bernice Chiappe by deed recorded on January 19, 1960 in Book 2258, page 160, San Joaquin County Records; thence Easterly along the North line of said parcel, also being an existing City Limits line, 213.2 feet, more or less, to the intersection of the same with the West line of the parcel of land annexed to the City of Lodi as the 'Thirty-ninth Addition," as described in City of Lodi Ordinance No. 440; thence North 00 10' East along the 44e5t line of said 'Thirty-ninth Addition," being also an existing City Limits line, 1830.14 feet, more or less, to the p i n t of beginning; the area thus described containing 93.1 acres, more or less. 3. Ihat the County Boundary Commission of San Joaquin County, California, did in session duly assembled on Tuesday, May 11, 1965, consider and approved the proposed annexation boundaries of said "Hutchins Estate Addition,' as above described, and as submittecS to said Commission by the proponents of said annexation. 4. That the Local Agency Formation Commission of San Joaquin County, California, did in session duly assembled on Friday, June 18, 1965, consider and approve the proposed annexation of said "Hutchins Estate Addition," as above described, and as submitted to said Commission by the proponents of said annexation. 5. That Wednesday, August 18, 1965, at the hour of 8:00 p.m., in the Council Chambers in the City Hall in the City of Lodi, County of San Joaquin, California, is..heteby fixed,as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to he annexed to the City of Lodi, and having any objections to the proposed annexation, may appear before the Council of the City of Lodi and show cause why such uninhabited territory should not be so annexed to the City of Lodi. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 6• That the City Clerk of the City of Ladi is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Lodi News -Sentinel, a newspaper of general circulation published in said City of Lodi, the city to which it is proposed to annex the aforesaid territory, and also in the Stockton Record, a newspaper of general circulation published outside the City of Lodi, but in the County of San Joaquin, California, the county in which is located the territory proposed to be annexed to the City of Lodi, said publication to be complete at least twenty (20) days prior to the date set for hearing. 7. That said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to W= land within the territory proposed to be annexed was assessed in the last equalized County assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with said Clerk, such notice to be given not less than twenty (20) days before the public hearing on the proposed annexation. 8. In the event there is, upon the land proposed to be annexed to said City a structural improvement owned, being acquired or leased by a County fire protection district, the City Clerk is directed to cause a written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the public hearing on such proposed annexation. 9. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
