HomeMy WebLinkAboutResolutions - No. 2798RESOLUIION NO. 2798 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY CF LODI CF UNINFABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED 'xETIEIMAN ADDITION," AND GIVING NOTICE OF TIME AND PLACE FOR HEARING PROTESTS THERETO BIC IT RESOLVED BY THE COUNCIL OF THE CITY CF LODI: 1- That pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of all of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roll of the County of San Joaquin, was filed with the Council of the City of Lodi on March 3, 1965, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be an- nexed to the City of Lodi and which said City and its Council propose to annex, is situate in the County of San Joaquin, State of California, hereby designated "Kettel.man Addition," and described as follows: A portion of the Southwest Quarter of Section 7, Township 3 North, Range 7 East, and a portion of the South- east Quarter of Section 12, Township 3 North, Range 6 East, Mount Diablo Base and Meridian and more particularly des- cribed as follows: Beginning at the Northeast corner of Walnut Orchard Tract as shown on map recorded in Volume 11, lage 157, Book of Maps and Plats, San Joaquin County Records, said point being also a corner of the existing City Limits; thence South 870 41' 17" East along the South line of the tract of land annexed to the City of Lodi as the "Freeway Addition," described in City of Lodi Ordinance No. 663, a distance of 305.18 feet, more or less, to the Northeast corner of the parcel of land described in deed to the 1. State of California, recorded December 16, 1960, in Book 2364 of Official Records, at page 6, San Joaquin County Records; thence leaving the City Limit line, South 00 501 42" East along the east line of said parcel, being the East right of way line of the U. S. Highway 99-50 Frontage Road, 1142.23 feet to a point; thence continuing Southerly along said East line of Frontage Road the follow- ing bearings and distances: along a curve concave t o the West having a radius 528 feet, through a central angle of 50 151 4211, a distance of 48.49 feet; thence South 4-° 25' West 297.02 feet; thence along a curve concave to the East having a radius of 272 feet, through a central angle of 400 20' a distance of 191.47 feet; thence South 35o 551 East 51.28 feet; thence along a curve concave to the West having a radius of 328 feet, through a csntral angle of 35° 271 30", a distance of 202.99 feet; thence South 00 271 30" East along the East line of said Frontage Road and said East line produced Southerly, 109.40 feet, more or less, to the South line of said Section 7; thence North 870 39' 51" West along said South line of Section 7, a dis- tance of 1185 feet, more or less, to the Southwest corner thereof; thence South 86o 31' West 46.80 feet, more or less, along the South line of Section 12, T. 3 K, R. 6 E., to the west line of State Highway X-SJ-4C(Cherokee Lane); thence North 00 3141 West along said West line of Cherokee Lane, being also a City Limit line, 1334.8 feet, more or less, to the Southwest corner of the tract of land annexed to the City of Lodi as the "Walnut Orchard Addition," des- cribed in City of Lodi Ordinance No. 349; thence South 870 401 East along the South line of said Walnut Orchard Addition 842.85 feet, more or less, t o the Southeast corner thereof; PA thence North to Olt West along the East line of said Walnut Orchard Addition 667.95 feet to the point of beginning; the area thus described containing 41 acres, more or less. 3. That the County Boundary Commission of San Joaquin County, California, did in session duly assembled on Tuesday, January 26, 1965, consider and approve the proposed annexation boundaries of said "Kettelman Addition," as above described, and as submitted to said Commission by the proponents of said annexation. 4. That the Local Agency Formation Commission of San Joaquin County, California, did in session duly assembled on Friday, February 19, 1965, consider and approve the proposed annexation of said "Kettelman Addition," as above described, and as submitted to said Commission by the proponents of said annexation. S. That Wednesday, Marciz 17, 1965, at the hour of 8:00 p.m., in the Council Chambers in the City Ball in the City of Lodi, County of San Joaquin, California, is hereby fixed as the time and place when and where any person owning real property within the City of Lodi, but not owning real property within the uninhabited territory above described and proposed to be annexed to the City of Lodi, and having any objections to the proposed annexation, may appear before the Council of the City of Lodi and show cause why such uninhabited territory should not be so annexed to the City of Lodi. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the pro- posed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 6' The City Clerk of the City of Lodi is hereby authorized and directed to cause a copy of this resolution to be published 3. at least once in the Lodi News Sentinel, a newspaper of general circulation published in said City of Lodi, the city to which it is proposed to annex the aforesaid territory, said publication to be complete at least four days prior to the date set for hearing.
