HomeMy WebLinkAboutResolutions - No. 2792RESCLUIION NO. 2792 RESOLIITION DECLARING THAT PROCEEDIl,T(S ARE HEREBY INITIATED BY THE COUNCIL CSF THE CITY OF LODI TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY OWNED BY THE CITY CF LODI, DESCRIBED HEREIN AND DESIGNATED "TALLEY ADDITION," AND GIVING NOTICE CF THE PROPO® ANNEXATION BE IT RFSOL ED BY THE COUNCIL OF THE CITY CF LODI: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings are hereby initiated by the Council of the City of Lodi, on its own motion, to annex to the City of Lodi all that uninhabited territory owned by said city ' situate in the County of San Joaquin, State of California, hereby designated as "Talley Addition" and described as follows: A portion of the Northeast Quarter of Section 10, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, and more particularly described as follows Beginning at a point on the East line of Section 10, Township 3 Ncrth, Range 6 East, Mount Diablo Base and Meridian, which point is also the Southeast corner of the parcel of land annexed to the City of Lodi as the "Westdale Addition," as described in City of Lodi Or- dinance No. 719; thence North 890 12JI West along the South line of said Westdale Addition, being also an existing City Limit line, 355.45 feet to a point; thence South and parallel to said East line of Section 10, a distance of 190.5 feet to a point on the South line of Lot 5, Talley Traet, as shown on a map f 1 e d for record August 19, 1953, in Volume 13, page 162, Book of Maps and Plats, San Joaquin County Records; thence South 890 12*t East along the South line of said Lot 5 and its Easterly projection 355.65 feet to the point of intersection of the same with the East line of said Section 10; thence North along said East line of Section 10 a distance of 190.5 feet to the point of 1. beginning; the area thus described containing 1.55 acres more or less. 2. That the Council of the City of Lodi desires to annex said uninhabited territory to the City of Lodi for the following reasons: The territory is contiguous to the City of Lodi, and its proposed annexation will contribute to and facilitate the orderly growth and development of the city and insure the proper use of land in conformity with the overall zoning plan of the city. 3. That the County Boundary Commission of San Joaquin County, California, did in session duly assembled on Tuesday, December 8, 1964, approve the proposed annexation boundaries of said "Talley Addition" as above described, and as submitted to said Co=J-ssiorL by the City of Lodi. 4. That the Local Agency Formation Commiss pori of San Joaqu.i.n County, California, did in session duly assembled on Friday, January 15, 1965, consider and approve the proposed annexation of said "Talley Addition", as above described, and as submitted to said Commission by the City of Lodi. 5. That Wednesday, February 17, 1965, at the hour of 8:00 g.m., in the Council Chambers in the City Hall in the City of Lodi, County of San Joaquin, California, is hereby fixed as the time and place when and where any person owning real property within the City of Lodi and having any objections to the proposed annexation, may appear before the Council of the City of Lodi and show cause why such uninhabited territory should not be so annexed t o the City of Lodi. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 2. 6. The City Clerk of the City of Lodi is hereby authorized and directed to cause a copy of this resolution to be published at least once in the Lodi News Sentinel, a newspaper of general circulation published in said city of Lodi, the city to which it is proposed to annex the aforesaid territory, said publication to be complete at least four days prior to the date set for hearing.
