RECOMMENDED ACTION: That the City Council authorize the City Manager and City Clerk to
execute the right-of-way agreement for 201 South Hutchins Street and
appropriate street funds to pay for this acquisition.
BACKGROUND INFORMATION: In 1990, the City began negotiations with the property owners on
the west side of Hutchins Street between Lodi Avenue and
Walnut Street to acquire 10 feet for the eventual widening of the
street to the existing setback line. At that time, only one property
owner sold the requested right of way. Because funds were not available for the construction of the
project, the City did not pursue the acquisition of the other rights of way.
In September 1995, the owner of the property at 207 South Hutchins Street approached the City
offering to convey the necessary right of way if the offer made to them in 1990 was still in effect. The
Council accepted this proposal and the deed was recorded. The other four property owners, who had
not granted rights of way in 1990, were again approached to see if they were now interested in selling.
The original owner of the property at 201 South Hutchins Street has died, but the new owner has
accepted the City's offer of $6,500. This offer covers the 10 -foot strip along Hutchins Street, a comer
cutoff at Walnut Street, and the improvements in the area of the acquisition.
A traffic engineer has been hired to prepare a traffic study for Hutchins Street in this area. Different
alternatives for the design of this street will be prepared and presented to the City Council for
consideration later this year. With this recent acquisition, shown shaded on Exhibit A, the rights of way
at 201, 207 and 235 South Hutchins Street have now been acquired. There are still three parcels left to
be acquired.
We feel it is in the City's best interest to purchase the property at 201 South Hutchins Street at this time.
FUNDING: Gas Tax Funds - $6,500
