IT IS HEREBY RESOLVER BY THE CITY COUNCIL QV Tia CITY OF
1_ That the City Council of the City of Lodi does hereby
determine that the public interest and convenience require the
establishment of a pedestrian mall within the east 160 feet of the
east-weat alley as shown in Block 9 on the map entitled "Mokttlm e"
(now City of Lodi), which map is on file in the office of the County
Recorder, San Joaquin County, and that vehicular traffic will not
be unduly inconvenienced by the establishment of said pedestrian
mall.
2 The description of the city street within which said
pedestrian mall is to be established is as hereinabove particularly
described, and said area is oommonly known as that portion of the
alley running between the Hotel Lodi and the Lodi Theatre Building
in an east -west direction, commencing at the west side of School
street and proceeding thence west to the property lines at the
rear of the buildings hereinabove described.
3. That there will be no mall intersections nor intersecting
streets affected by the establishment of said pedestrian mall.
4. That the City Council of the City of Lodi proposes to adopt
an ordinance prohibiting in whole or in part, vehicular traffic
on said pedestrian mall, except that certain classes of vehicles
may use the same during certain days or during portions of the day
for the purpose of loading and unloading merchandise.
5. That the City does not propose to pay any city funds to
any property owner by reason of any damages which may be suffered
by the establishment of the pedestrian mall.

6. That Wedaesda,y, May 15, 1963 at the hour of a P. M. of said
day in the eounail chambers at the City Hall in the City of Fadi,
California, the City Council of the City of Lodi will hear protests
and objeations to the establishment of the proposed pedestrian
mall. Any and all persons having any objection to the establish-
ment of the proposed pedestrian mall may file a written protest with
the City Clerk of the City of Lodi at the Oity Hall, Lodi, Cali-
fornia, at any time not later than the hour fixed herein for the
hearing.
?. That any yerson owning or having any legal or equitable
interest in any property which might suffer legal damage by reason
of the establishment of the proposed pedestrian mall may file a
written claim of damages with the Clerk of the City of Lodi at auy
time not later than the hour so fixed herein for hearing; that such
written claim must describe the real property as to which the claim
is made, must state the exact nature of the claimant's interest
therein, must state the nature of the claimed damage thereto, and
must state the amount of damages claimed; that failure to file
such written claim within the time provided shall be deemed a
waiver of any claim for damages or com,pensatioa and shall operate
as a bar to airy subsequent action seeking to prevent the establish-
ment of said pedestrian mall or to recover damages on account of
such establishment; that the filing of such a claim shall operate
ae a bar in any subsequent action for the recovery of asW damage
or compensation in excess of the amount stated in such claim.
8. The City Clerk of the City of Lodi is hereby directed to
ea.use a copy of this Resolution to be published, posted and mailed
in accordance with the provisions of Section 11300, 11301 and
11302 of the Streets and Highway Code. In addition to mailing a

copy of said Resolution to the owners of all parcels of land
abutting upon aaid pedestrian mall, the City Clerk is hereby
directed to send, by certified mail with return receipt requested,
a copy of this Resolution to LOUISE GRAMCNA, P. 0. Box 150,
Lodi. California; IDA GRA-'FTGNA, et al, 820 North California Street,
Lodi, Ca.liforiaia; C. L. and A. E. BECK", 850 E. Kettleman Lane,
Lodi, California; and UNITED CALIFORl-UA THEATRE, INC., 172 Golden
Gate Avenue, San Francisco, California.

!Chis is to certify that the foregoing is a true and correct
copy of Resolution No. 2598 adopted by the City Council of the
City of Lodi at a duly regularly held and called meeting of the
said City Council on Wednesday, February 6, 1963, and that said
Resolution was adopted by the following votes
