That, pursuant to provisions of the Annexation of Unin- habited Territory Act of 1939, a petition signed by owners of all of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roil of the County of San Joaquin, was filed with the Council of the City of Lodi on February 6, 1963, requesting annexation of the hereinafter des- cribed territory to said City. 2. That the territory which the petitioners request be annexed to the City of Lodi and which said City and its Council propose to annex, is situate in the County of San Joaquin, State of California, hereby designated "Erich Addition," and described as follows: Beginning at a corner of the boundary line of the City or Lodi, which point is on the East line of the Northeast Quarter of Section 3, Township 3 North, Range 6 East, Mount Diablo Base and Meridian and 743.3 feet northerly from the Southeast corner of said Northeast Quarter; thence Westerly 968 feet along a line parallel to the South line of said. Northeast Quarterto a corner of the City boundary line, which point is the true point of beginning; thence continu- ing North 88° 54' West a distance of 552 feet, more or less, to the East line of the property deeded to Everts F. M i 11 s et ux, as recorded January 6, 1.956 in Volume 1826, page 27, Sari Joaquin County Records; thence Northerly 16.7 feet, more or Less, along the East boundary of said Mills property to a corner of said property; thence Westerly 1,070 feet, more or less, along the North boundary of said Mills prop- erty to the East line of Sacramento Road, which line is 40 feet East of the West line of the Northeast Quarter of Section 3; thence Northerly 1050 feet, more or less, along the East line of Sacramento Road to the South line of the 77.07 acre tract deeded to Raymond Leslie Gerard, as re- corded April 8, 1909 in Book "A" of Deeds, Volume 158, page 365, San Jk.,aquin County Records, which line is 1,207.5 feet South of the North line of said Northeast Quarter; thence Easterly 1,016.1 feet along a line parallel to the North line of said Northeast Quarter to a corner of the existing City Boundary; thence North 88° 38' East a distance of 55.9 feet along the City Boundary to a corner of said boundary; thence South 0° 8' West 238.2 feet along the City Limit Line to a boundary corner; thence North 89° 58' East 557.3 feet along the City Boundary Line to a boundary corner; thence Southerly 854.8 feet along a line parallel to the East line of said Northeast Quarter of Section 3, this line also a City Boundary Line, to the true point of beginning; the area thus described containing 36.6 acres, more or less. 3. That the County Boundary Commission of San Joaquin County, California, did in session duly assembled on Tuesday, December 4+, 1962, consider and approve the proposed annexation boundaries of said "Erich Addition," as above describes„ and as submitted to said Commission by the proponents of said annexation. 4. That Wednesday, March 20, 1963, at the hour of 8 p.m., in the Council Chambers in the City Hall in the City of Lodi, County of San Joaquin, California , is hereby fixed as the time and place when and where dny person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Lodi, and having any objections to the proposed annexation, may appear before the Council of the City of Lodi and show cause why 2. such uninhabited territory should not be so annexed to the City of Lodi. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexa- tion, nnexa- tion, and shall state the name or names of the owner or owners of property affected and the descriktion and area of such property, in general terms. 5. The City Clerk of the City of Lodi is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Lodi News Sentinel, a newspaper of general circulation published in said City of Lodi, the city to which it is proposed to annex the aforesaid territory, said publication to be complete at least twenty days prior to the date set for hearing. 6. The said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with said Clerk, such notice to be given not less than twenty days before the first public hearing on the proposed annexation. 7. In the event there is, upon the land proposed to be annexed to said City, a structural improvement owned, being acquired or leased by a county fire protection district, the City Clerk is directed to oe se written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten days before the first public hearing upon such proposed annexation. 8. Thip City' Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law. Dated: February 6, 1963. 3.
