MEETING DATE: March 20, 1996 PREPARED BY: Kirk J. Evans, Administrative Assistant to the City Manager RECOMMENDED ACTION: That City Council review the attached rate adjustment application from California Waste Removal Systems (CWRS) and approve a 4.17% increase in residential and commercial refuse collection rates for 1996-97. BACKGROUND INFORMATION: Over the past four years, City Council has followed a Rate Methodology - adopted by Council December 4, 1991 - for establish- ing residential and commercial refuse collection rates in the City of Lodi. Discussing rate increases for any form of service is never an enjoyable subject. However, this methodology has allowed Council and staff to follow a regular, systematic process for reviewing and setting refuse rates. Last year, you will recall CWRS requested no rate increase. Rates at multi -family dwellings actually dropped by $1.00 per month. Rates for various forms of commercial container service were reduced ranging between 18% and 24%. The detailed rate application submitted by CWRS last year marked the beginning of a two year adjustment cycle (somewhat similar to the City of Lodi two year budget cycle). This year represents an "index year" in the cycle. CWRS is now filing a 1996-97 rate adjustment request based on a Composite Cost Index (CCI) formula which is part of the adopted rate methodology (Exhibit D). Weighted indices for payroll (Employment Cost Index), gasoline (CPI for gasoline), and other expenses (U.S. CPI), as well as projected changes in depreciation, equipment lease expenses and disposal, transfer, materials processing expenses have all been factored into the CCI formula -- resulting in a 4.17% rate increase. Most of this rate increase (53%) is attributable to a gate fee increase of $4.48 per ton at the North County Landfill. CWRS must now pay $24.41 per ton to use this facility (effective April 1, 1996). As has been the practice since the landfill opened, CWRS pays $5.00 per ton less than any other collector using the landfill without first recycling materials out of their waste stream. The County Board of Supervisors recently approved these new gate fees to cover additional monitoring and closure costs (imposed by the State) at the old Harney Lane Landfill. Part of this fee is also intended to provide for construction of the next cell of the North County Landfill. It is interesting to note the Board also raised gate fees at the Lovelace Transfer Station (which Lodi does not use), from $30.61 per ton to $38.15 per ton. The remainder of this rate increase is primarily attributable to expenses resulting from increased waste tonnage transferred from Lodi to the North County Landfill, inflation and moderate capital improvements. Lodi is growing. Despite a high diversion rate of over 30%, the total amount of waste Lodians landfill will only increase with the passage of time. Two-thirds of Lodi's waste stream is still landfilled. As more people and businesses add to Lodi's waste generation base, more waste must be landfilled. APPROVED: H. Dixon Flynn — City Manager 0 CITY OF LODI COUNCIL COMMUNICATION The effect of this rate adjustment is a 66 cent per month increase in single-family residential curbside collection service, a 45 cent per month increase in low volume producer (20 gallon cart) service, and a 62 cent per month increase for multi -family residential service (Exhibit A). All of these increases, as well as changes to the commercial refuse collection schedule (Exhibit B), and commercial roll -off box schedule (Exhibit C), represent an across-the-board adjustment of 4.17%. FUNDING: Should City Council approve this application, new refuse collection fee revenues would provide all necessary funding to cover costs outlined in the application. Kirk J. The application has been prepared in accordance with the Index Year Rate Procedure specified in the rate methodology. The Index Year Rate Adjustment formula results in a requested increase of 4.17% or $.66 for basic residential service. As you will recall, this is the first requested increase in two years. The majority of the increase is necessary to cover increased disposal fees. As you are aware, San Joaquin County recently increased the landfill fees at Harney Lane by 22.53%. The impact on the Lodi residential and commercial custorners has been minimized due to the excellent participation in recycling and yard and garden waste diversion programs. The attached application provides the details of the requested rate adjustment, the resulting rates, as well as explanatory notes. The requested rate change is assumed to be effective April 1, 1996. The Employment Cost Index for the period December 1994 through December 1995 increased by 2.5%. The 2.5% indexed increase in payroll expenses results in a .39% Composite Cost Index component. 2. Equipment: As specified in the Index Year Rate Procedure of the Rate Methodology, equipment expenses have been adjusted by the percentage change in the U.S_ CPI for gasoline for the most recent 12 month period. The CPI for gasoline for the period December 1994 through December 1995 declined by 4.2%. The 4.2% indexed decline in equipment expenses results in a -.35% Composite Cost Index component. Depreciation, Interest, Equipment Lenses, and Debt Service: As specified in the Index Year Rate Procedure of the Rate Methodology, depreciation, interest, equipment leases and debt service have been updated to include capital additions. Only minimal capital additions are anticipated for the replacement of fully depreciated equipment. The impact on the Composite Cost Index is only .02%. 4. Disposal, Transfer, and Materials Processing: As specified in the Index Year Rate Procedure of the Rate Methodology, expenses related to disposal, transfer and materials processing have been calculated to reflect the change in the costs associated with these functions. Changes in disposal, transfer and materials processing expenses result in a 4.02% Composite Cost Index component. The 4.02% Composite Cost Index component is the net result of the following: 2.22% Disposal Expenses: Disposal expenses have increased primarily due to the 22.5% increase adopted by San Joaquin County at the Harney Lane Landfill, as well as a moderate increase in disposal tonnages. 1.86% Transfer Expenses: Transfer expenses have increased primarily due to an increase in the tonnage being transferred for Lodi customers, and an increase in the transfer cost per ton due to inflation, and moderate capital improvements. -.06% Allocated Materials Processing: Although the volume of recyclable materials processed for the City of Lodi is anticipated to increase, allocated materials processing expenses are projected to decline as a result of lower per ton processing charges. The per ton processing charge at the CWRS regional materials recovery facility is anticipated to decline as a result of the higher volume of materials being processed for multiple jurisdictions, allowing fixed costs to be spread over a larger volume of materials. 4.02% Disposal, Transfer and Materials Processing Composite Cost Component Other Expenses: As specified in the Index Year Rate Procedure of the Rate Methodology, all other expenses have been increased by the percentage change in the U.S. CPI for the most recent 12 month period. The U.S. CPI for the period December 1994 through December 1995 increased by 2.5%. The 2.5% increase in other expenses results in a.59% Composite Cost Index component. 6. Projected Customer Base Increase: As specified in the Index Year Rate Procedure of the Rate Methodology, The Composite cost Index is reduced by 50% of the anticipated growth in customer accounts. The growth in customer accounts has been estimated to be 1%, which is consistent with City growth estimates. The estimated 1% growth in customer accounts results in a -.50% Composite Cost Index component. Ordinance 1605, adopted March 15, 1995, is repealed in its entirety. Section 2. Pursuant to Lodi Municipal Code Chapter 13.16 - SOLID WASTE - as it relates to residential solid waste collection, new monthly rates are hereby established, as more fully shown on Attachment "A" hereto, which is incorporated by reference as if fully set forth herein. A. For any residence requesting "backyard service" for the collection of their waste cart(s), there shall be an additional rate of Ten Dollars ($10.00) per month, unless the residence is granted an exemption from the rate by the Citizen's Advisory Board. B. For any residence requesting a commingled recyclables cart(s) and/or a yard/garden waste cart(s), sufficient to meet its waste diversion needs, there shall be no additional charge. C. Any residential customer may purchase from the City or the franchisee for the price of Five Dollars ($5.00) each, especially marked tags for affixing to trash bags which will then be collected with routine waste removal service. Such tags may be used to supplement, but not in lieu of other required solid waste collection services for residences. D. Rates set forth in this Ordinance shall be effective on all bills which are prepared on or after April 1, 1996. Section 3 - No Mandatory Duty of Care. This ordinance is not intended to and shall not be construed or given effect in a manner which imposes upon the City, or any officer or employee thereof, a mandatory duty of care towards persons or property within the City or outside of the City so as to provide a basis of civil liability for damages, except as otherwise imposed by law. Section 4 - Severability. If any provision of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application. To this end, the provisions of this ordinance are severable. The City Council hereby declares that it would have adopted this ordinance irrespective of the invalidity of any particular portion thereof. Section 5. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. Section 6. This is an urgency ordinance under Government Code §36934, and is based on health, safety and welfare considerations arising from the need to collect appropriate fees for waste removal. Section 7. This urgency ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect immediately. Section The City Council of the City of Lodi hereby finds and declares pursuant to Public Resources Code §21080 that such rates are necessary and reasonable for the usual operating expenses of the franchisee, including employee wages and benefits and for the purpose of purchasing facilities, equipment and materials necessary to implement and carry out a Council -mandated recycling program, and for other health and safety purposes. Ordinance 1592, adopted March 16, 1994, is repealed in its entirety, and shall be of no further force or effect. Section 2 - Rates: A. The rates to be charged for commercial 10 to 50 cubic yard roll -off box collection service shall be as follows: 1. For owners or tenants of business houses, the rates shall be as set forth in the Commercial 10 to 50 Cubic Yard Roll -Off Box Rate Structure schedule attached, when such service is requested. B. All of the rate schedules set forth in this section shall be effective on all bills which are prepared on or after April 1, 1996. Section 3 - No Mandatory Duty of Care. This ordinance is not intended to and shall not be construed or given effect in a manner which imposes upon the City, or any officer or employee thereof, a mandatory duty of care towards persons or property within the City or outside of the City so as to provide a basis of civil liability for damages, except as otherwise imposed by law. Section 4 - Severability. If any provision of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application. To this end, the provisions of this ordinance are severable. The City Council hereby declares that it would have adopted this ordinance irrespective of the invalidity of any particular portion thereof. Section 5. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. Section 6. This is an urgency ordinance under Government Code §36934, and is based on health, safety and welfare considerations arising from the need to collect appropriate fees for waste removal. Section 7. This urgency ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect immediately. Section 8. The City Council of the City of Lodi hereby finds and declares pursuant to Public Resources Code §21080 that such rates are necessary and reasonable for the usual operating expenses of the franchisee, including employee wages and benefits and for the purpose of purchasing facilities, equipment and materials.
