HomeMy WebLinkAboutResolutions - No. 2005-124A RESOLUTION OF THE LODI CITY COUNCIL ESTABLISHING AN AREA OF BENEFIT AND REIMBURSABLE COSTS FOR LEGACY ESTATES, UNIT NO. 1, TRACT NO. 3260 WHEREAS, Legacy Estates, Unit No. 1, subdivision is located north of Harney Lane, east of Lower Sadramento Road, and south of DeBenedetti Park; and WHEREAS, the Developer, FCB Building Partners ]I, entered into an improvement agreement with the City on November 24, 2003, which required the installation of certain public improvements, including the public sewer trunk line in Harney Lane, to serve the proposed subdivision and other properties (Exhibit A, Site Nos. 9 through 39) inside the Harney Lane Lift Station Service Area. The public improvements also include t.he,frontqge irr provem.ents for 2189 West Harney Lane (Site No. 14) on Legacy Way and Harney Lane and future water and sewer extensions benefiting the properties northwest of the Legacy Estates, Unit No. 1 (Site Nos. 23, 24, and 25); and WHEREAS, the developer has requested a reimbursement agreement and establishment of an area of benefit in conformance with Chapter 16.40 of the Lodi Municipal Code for those improvements that benefit the neighboring properties; and WHEREAS, a copy of the itemized costs for the reimbursable improvements is attached as Exhibit B; and WHEREAS, the acreages and site numbers used in the reimbursement calculation are consistent with acreage and site numbers established in the previously -adopted Area of Benefit for the Harney Lane Sewer Lift Station Improvements (RA -03-04); and WHEREAS, in conformance with Lodi Municipal Code Section 16.40, staff recommended that the City Council conduct a public hearing to establish an area of benefit and reimbursable costs to recover the costs for those improvements that benefit the neighboring properties as shown on Exhibit C. attached; and WHEREAS, pursuant to Lodi Municipal Code Section 16.40.50.A.3, the reimbursable amounts will be recalculated and adjusted annually in January to include an amount attributable to interest. The "annual adjustment will be based on the change in the Engineering News Record (ENR) 20', Cities Construction Cost Index from January 1 of the previous year. The beginning ENR index will be 7308. NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that: a) The City Council hereby establishes an area of benefit and reimbursable costs to recover the costs for those improvements that benefit the neighboring properties, as shown on Exhibit A attached, and shall be collected at the time of deveiopment for each parcel; and b) Fursuart to Lodi Municipal Cod amounts will be recalculated and amount attributable to interest, usi Cities Construction Cost Index fr beginning ENR index will be 7308.
