AGENDA TITLE: Acceptance of Improvements Under Wastewater Pipe Improvements, Alley South
of Locust Street, Washington Street to Cherokee Lane Contract
MEETING DATE: March 6, 1996

RECOMMENDED ACTION: That the City Council accept the improvements under the "Wastewater
Pipe Improvements, Alley South of Locust Street, Washington Street to
Cherokee Lane" contract, and direct the City Engineer to file a Notice of
Completion with the County Recorder's office.
BACKGROUND INFORMATION: The contract was awarded to Crutchfield Construction, of Stockton,
on April 19, 1995 in the amount of $152,350.00. The contract has
been completed in substantial conformance with the plans and
specifications approved by the City Council.
The contract completion date was August 17, 1995, and the actual completion date was
August 11, 1995. The final contract price was $160,882.10. The difference between the contract
amount and the final contract price is mainly due to additional work needed to avoid a grade conflict
with existing electrical conduits. The contractor also discovered several sewer services that were still in
use and had to be cut into the new main.
Two claims were filed against the City and the contractor as a result of this project. The City held up
acceptance of the project until both claims were settled. Crutchfield Construction and its insurance
company have agreed to pay both claims and our Deputy City Attorney is satisfied that we can now
accept the project and begin the procedures for the release of the retention.
