RESOLUTION O F EVIDENCE O F COMPLIANCE WITH
CONDITIONS SET FORTH IN OFFICE OF PLANNING
AND RESEARCH LETTER OF MAY 24, 1978.
W'HEREAS, the City Council of the City of Lodi
has requested of the State of California, Office of Planning
and Research, an extension of time to complete the Safety,
Seismic Safety, Noise and Housing Elements of the Lodi
General Plan; and
WHEREAS, the said Office of Planning and
Research has issued its letter of May 24, 1978 granting an
extension of time to complete the Safety, Seismic Safety and
Noise Elements of the Lodi General Plan for the -period
May 24, 1978 to October 1, 1978; and
WHEREAS, it is the City of Lodi's understanding
that it will review and approve proposed developments prior
to the aforesaid Elements' adoption on the basis of
Resolution No. 78- 16 and 78- 17 of the City of Lodi; and
WHEREAS, the aforesaid letter of May 24, 1978,
in granting the extension of time to complete the Safety,
Seismic Safety and Noise Elements of the Lodi General Plan,
set forth certain conditions for the granting of the extension;
NOW, THEREFORE, BE IT RESOLVED by the
City Council of the City of Lodi that the following conditions
are adopted in connection with the granting of the extension
of time by the Office of Planning and Research to October 1,
1978 for the adoption of the City of Lodi's Safety, Seismic
Safety and Noise Elements:

1. No zoning ordinances shall be enacted until such time
as all mandatory elements required by law have been
adopted according to State law with the exception of
the following:
(a) Interim ordinances adopted pursuant to Govern-
ment Code 65858.
(b) More restrictive zoning needed to maintain exist-
ing and planned uses in an area following expiration
of an interim ordinance and pending final adoption
of all mandatory elements of the General Plan.
(c) Rezoning which is less restrictive, but where the
maintenance of existing zoning would create a
hardship and the new use is contiguous to existing
compatible uses. Such rezonings shall be accom-
plished by a finding of hardship setting forth those
social and economic reasons justifying immediate
rezoning pending the final adoption of all mandatory
elements and setting forth the express findings of
the new zoning ordinances with each of the existing
elements of the City of Lodi General Plan.
20 Tentative and final subdivision maps and parcel maps will
only be approved by the City if they are consistent with the
existing elements of the City of Lodi General Plan and if
such approval would not adversely affect an area of con-
cern which any of the missing elements, as specified in the
State General Plan Guidelines, is intended to mitigate.
3. The City shall follow all other policies and procedures as
outlined in the extension request application.
