HomeMy WebLinkAboutResolutions - No. 78-49RESOLUTION NO. 78-49 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI DETERMINING THAT A SCENIC HIGHWAY ELEMENT IS NOT REQUIRED AS PART OF THE LODI GENERAL PLAN. WHEREAS, Section 65302(h) of the Government Code of the State of California lists a Scenic Highway Element as a mandatory element of a City or County General Plan; and WHEREAS, Article 2.5 (commencing with Section 260) of Chapter 2, Division I of the Streets and Highways Code of the State of California outlines the Legislative Intent for Scenic Highways; and WHEREAS, Sections 263.3, 263.4, 263.5, 263.60 263.7 and 263.8 of said Streets and Highways Code list the State Highway Routes which have been designated "Scenic State High- ways"; and WHEREAS, besides State Highway Routes, a local legislative body may designate local streets and highways as "Scenic Routes"; and WHEREAS, neither State Route I2 nor 99 within the corporate limits of the City of Lodi have been designated as a "Scenic Route": and WHEREAS, the Lodi City Council has not designated any local streets or highways as "Scenic Routes"; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi that since the City has no "Scenic Highway Routes" either by State or local determination, that said City Council finds a Scenic Highway Element as required by Section 65302(h) of the Government Code of the State of California is not required as an Element of the Lodi General Plan.
