HomeMy WebLinkAboutResolutions - No. 78-16RESOLUTION NO. 78-16 RESOLUTION REQUESTING A TIME EXTENSION TO SEPTEMBER 1, 1978 FOR COMPLETION OF THE SAFETY AND SEISMIC SAFETY ELEMENTS OF THE GENERAL PLAN BY THE CITY OF LODT. WHEREAS, the City of Lodi has not adopted the Safety Element and the Seismic Safety Element of its General Plan as have been mandated by Sections 65302,1 and 65302(f) of the Government Code of the State of California; and WHEREAS, the City intends to combine the two aforementioned Elements into the Safety/Seismic Safety Element and adopt it as one Element since the two Elements are closely related and over- lapping; and WHEREAS, Government Code Section 65302.6 enables the State Director of Planning and Research to grant an extension of time for completion of General Plan Elements if certain findings are made; and WHEREAS, staff limitations, brought on by successive resig- nations of those persons working on the Elements, have precluded earlier completion of the Elements; and WHEREAS, data on flooding, one of the greatest potential hazards to public safety in the City and San Joaquin County, has not been available; and WHEREAS, the City has been waiting for the Federal Flood Insurance Administration and the United States Army Corps of Engineers to provide this data on flooding; and WHEREAS, the data was expected in 1975 but was not received until November 1977 and will not be in final form until April 1978; and WHEREAS, the City of Lodi has been using the Safety Element and the Seismic Safety Element of the San Joaquin County Council of Governments as an interim basis for decision making; and WHEREAS, the City of Lodi has granted and will continue to grant land use approvals only to those projects which are consistent with its existing General Plan Elements and on the basis of available information must be consistent with the new elements being studied and considered; and -I- WHEREAS, the City of Lodi is following the policies and procedures specified in a separate portion of this request; and WHEREAS, it is estimated that the aforementioned Element can be completed and adopted by September 1, 1978; WHEREAS, James B. Schroeder, Community Development Director for the City of Lodi is authorized to act as the contact person with the Office of Planning and Research concerning the extension; and WHEREAS, the City of Lodi is not involved in litigation con- cerning or related to the completeness and adequacy of its General Plan; NOW, THEREFORE, BE IT RESOLVED that the City of Lodi does hereby request the Director of Planning and Research to grant an extension to September 1, 1978 for completion and adoption of the Safety and Seismic Safety Elements.
