HomeMy WebLinkAboutResolutions - No. 4346RESOLUTION NO. 4346 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI DESIGNATING A SOLID WASTE ENFORCEMENT AGENCY WHEREAS the County of San Joaquin and its incor- porated cities are required by Section 66796 of the Government Code to designate an enforcement agency to carry out the pro- visions of the Z'Berg-Kapiloff Solid Waste Control Act of 1976; and WHEREAS the San Joaquin Local Health District possesses the required capabilities in environmental health and solid waste management to implement the Z'Berg-Kapiloff Solid Waste Control Act of 1976 and the regulations and ordi- nances that have been and will be adopted pursuant thereto; and WHEREAS the San Joaquin Local Health District has been given sufficient personnel and an adequate budget to carry out the enforcement program specified by law; and WHEREAS the County and each city within the County of San Joaquin has designated or will designate its own enforce- ment agency(ies); NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi that it hereby designates the San Joaquin Local Health District as the enforcement agency for the City of Lodi pursuant to subsection (a)(3) of Section 66796 of the Government Code. REIMCHE City Clerk BOB McNATT City Attorney Re; Affirmation of Resolution Designating San Joaquin County Public Health Services Environmental Health Division as the Solid Waste Local Enforcement Agency The City of Lodi hereby affirms Resolution No. 4346 dated April 20, 1977 which designates the San Joaquin County Public Health Services, Environmental Health Division as the Local Enforcement Agency for the Solid Waste program within the jurisdiction of San Joaquin County pursuant to the California Integrated Waste Management Act of 1989 also known as Assembly Bill 939 and Section 18052, Title 14 Division 7 of the California Code of Regulations. Box 3006 Lodi, CA 95241-1910 RE: Letter of Affirmation FEB 0 5 '92 City Manager's Office On July 1, 1989 the San Joaquin Local Health District was absorbed into San Joaquin County government system through state,legislation. The District is now known as San Joaquin County (SJC) Public Health Services. Due to the name change and recent legislation AB939 SJC Public Health Services is now required to be re -designated as the solid waste local enforcement agency, CCR Section 18052 (a). The Environmental Health Division of the County Public Health Services has been acting as solid waste local enforcement agency since May of 1977 when all six cities of San Joaquin County designated it with their City Council resolutions. Since the City of Lodi has already designated the Local Health District on April 20, 1977, Resolution No. 4346 (enclosed) only a "letter of affirmation" to re -designate the County Public Health Services, Environmental Health Division as the local enforcement agency will be needed from your office. A sample "letter of affirmation " is enclosed. Please return the letter of affirmation within 10 days to help Public Health Services Environmental Health Division expedite the application process.
