RESOLUTION NO. 4279
RESOLUTION AUTHORIZING EXECUTION OF PEED
TO CHRIS R. KESZLER, ET AL,
WHEREAS, John F. CapeII, et al heretofore conveyed the
hereinafter described property to the City of Lodi for use as a storm
drainage pond; and
WHEREAS, said Deed, dated June 17, 1975, was recorded
February 18, 1976, in Book 4085, Page 82, Instrument 7727, Official
Records of San Joaquin County; and
WHEREAS, said Deed contained the following clause:
"This grant is made upon the express condition that in the case of
abandonment of the above described property by Grantee for the pur-
pose of storing storm and surface water drainage thereon, the
Grantors, their heirs, successors or assigns shall have the right to
re-enter and to hold, own, and possess the same and the title to said
property shall revert to the Grantors, their heirs, successors or
assigns as if this conveyance had never been made." ; and
WHEREAS, the City of Lodi has no further need for the use
of said property for storing storm and surface water drainage;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Lodi that the Mayor and City- Clerk of the City of Lodi
are hereby authorized to execute a Quitclaim Deed from the City of
Lodi to the Grantors, or their successors, named in the above
described Deed so that the City of Lodi will no longer have any interest
in said property.
The real property affected by this Resolution is situate in the
City of Lodi, County of San Joaquin, State of California, and is
described as follows:
Being a portion of the Northeast Quarter of
Section 10, Township 3 North, Range 6 East, Mount Diablo
Base and Meridian, said parcel being rnore particularly
described as follows:
Commencing at the Southwest corner of that
certain parcel of land shown on Map of Survey recorded
in Book of Surveys, Volume 24, Page 91, San Joaquin
County Records; thence North 00* 02' 30" West, 32.00
feet along the westerly boundary line of said parcel of
land to the TRUE POINT OF BEGINNING; thence
continuing along the westerly boundary line of said
parcel of land North 00° 02' 30" West, 320.00 feet;
thence South 890 12.' 30" East, 250.00 feet; thence
South 00° 02' 30" East, 320.00 feet to a point, said
point lying 32.00 feet northerly of the southerly
boundary line of said parcel of land; thence North
89° 12' 30" West, 250.00 feet along a line parallel
with, measured 32.00 feet northerly of, at right
angles to, the southerly boundary line of said parcel
of land to the TRUE POINT OF BEGINNING, contain-.
ing 1.837 acres more or less.

I hereby certify that Resolution No. 4279 was passed
and adopted by the City Council of the City of Lodi in
a regular meeting held November 3, 1976 by the
following vote:
