HomeMy WebLinkAboutResolutions - No. 4203RESOLUTION NO, 4203 A RESOLUTION APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "FILLEY ADDITION" TO THE CITY OF LODI. WHEREAS, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by all of the owners of certain uninhabited territory, hereinafter more particularly described, was presented to the City of Lodi, which petition did request annexation of said territory to the City of Lodi; and WHEREAS, said petition was presented to the San Joaquin County Local Agency Formation Commission for their approval and the approval of that body was given at its meeting held May 2 1, 1976; and WHEREAS, the San Joaquin County Local Agency Formation Commission granted the City of Lodi power to waive notice and hearing on the proposed annexation pursuant to the provisions of Section 54797.1 of the Government Code; and WHEREAS, said petition was presented to the City Council of the City of Lodi at a regular meeting held June 2, 1976; and WHEREAS, the City Council of the City of Lodi finds the foregoing statements to be true and correct; that said territory is contiguous to the City of Lodi, and that the same is uninhabited territory in the County of San Joaquin; NOW, THEREFORE, the City Council of the City of Lodi does hereby approve the annexation to the City of Lodi of the territory herein- after described and does hereby further resolve that saicl,,territory be and the same is hereby annexed to the City of Lodi. That said territory, the annexation of which is described as follows: Being a parcel of land lying within the Southeast 1/4 of Section 10, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, and being more particularly described as follows: Commencing at a railroad spike at the center of said Section 10 as shown on that Parcel Map recorded in Book 2. of Parcel Maps, page 144, San Joaquin County Records, said point also being on the center line of the 80.00 foot wide right- of-way for Lower Sacramento Road; thence South 89° 12' 30" East 40.00 feet along the northerly line of said Southeast 1/4 of Section 10 to a point on the east line of said Lower Sacramento Road and the TRUE POINT OF BEGINNING; thence continuing South 89' 12 30" East 2602.00 feet more or less, along said northerly line, being the City Limits line of the City of Lodi, to the east line of said Southeast 1/4 -section: thence South 00' 02' 30" East 400.00 feet along said east line, said line also being the City Limits line of the City of Lodi; thence leaving City Limits line, North 89° 11' 30" West 1365.29 feet; thence South 240.00 feet; thence North 89° 12,' 30" West 600.00 feet; thence North 440.00 feet; thence North 89' 12' 30" West -2- 637, 00 feet to the east line of said 80. 00 foot wide right-of-way for Lower Sacramento Road; thence North 200.00 feet along said east line to the true point of beginning, containing 24.28 acres, more or less.
