HomeMy WebLinkAboutResolutions - No. 4100I RESOLUTION NO. 4100 A HESOLUTION APPKOVING THE ANNEXATION OF CERTAIN UNINHABITED TERKITORY, DESIGNATED "WEST TURNER ROAD ADDITION" TO THE CITY OF LODI. WHEKEAS, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by all of the owners of certain uninhabited territory. hereinafter more particularly described, was presented to the City of Lodi, which petition did request annexation of said territory to the City of Lodi; and, WHEREAS, said petition was presented to the San Joaquin County Local Agency Formation Commission for their approval and the approval of that body was given at its meeting held August 15, 1975; and, WHEREAS, the San Joaquin County Local Agency Formation Commission granted the City of Lodi power to waive notice and hearing on the proposed annexation pursuant to the provisions of Section 54797. 1 of the Government Code; and, WHEREAS, the West Turner Road Addition covers the uninhabited annexation of 0.8 acres, consisting of an approximately 1,300 feet length of the northerly traffic lane of West Turner Road; and WHEREAS, the San Joaquin County Board of Supervisors has adopted Resolution No. .,-73-2639 providing blanket consent to annexation of County Roads. A copy of said resolution is on file in the office of the City Clerk: and, WHEREAS, the City Council of the City of Lodi finds the foregoing statements to be true and correct; that said territory is contiguous to the City of Lodi, and that the same is uninhabited territory in the County of San Joaquin; NOW, THEREFORE, the City Council of the City of Lodi does here- by approve the annexation to the City of Lodi of the territory hereinafter described and does hereby further resolve that said territory be and the same is hereby annexed to the City of Lodi. That said territory, the annexation of which is described as follows: A portion of the Southwest and Southeast Quarters of Section 34, Township 4 North, Range 6 East, Mount Diablo Base and Meridian, being more particularly described as follows: Beginning at a point in the south line of said Section 34, said point lying 40 feet East of the Southwest corner of said Southeast Quarter, and being the Northwest corner of the parcel of land annexed to the City of Lodi as the "RUTLEDGE ADDITION" and described in City of Lodi Resolution No. 2875; thence East, along the North line of said "RUTLEDGE ADDITION", and its easterly productioi _ _.ng along the existing City L i -ine, 1160.04 feet to the -Southwest corner of the parcel of land annexed to the City of Lodi as -the "NORTH GENERAL MILLS ADDITION" as described in City of Lodi Ordinance No. 836; thence North 7" 12' East along the West line of said "NORTH GENERAL MILLS ADDITION, !' 27.22 feet; thence leaving said existing City Limit line, West along a line 27. 00 feet northerly of (measured at right angles) the south line of said Southeast Quarter, a distance of 1243.46 feet to a point in the westerly line of said Southeast Quarter of Section 34; thence North 1 49' West along said westerly line of said Southeast Quarter, a distance of 3.00 feet; thence West 40.00 feet to the intersection of the north line of 60 foot wide Turner Road with the northerly production of the west line of Lower Sacramento Road; thence southerly along said northerly production, 30.00 feet to a point in the South line of said Section 34; thence easterly along said South line of Section 34, a distance of 80. 00 feet to the point of beginning, the area described containing 0.8 acre, more or less. BE IT FURTHER RESOLVED that the terms and conditions of annexation are none.
