HomeMy WebLinkAboutResolutions - No. 4065RESOLUTION NO. 4065 DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF LODI TO VACATE ALLEYS LOCATED BETWEEN LOTS 1, 2, AND 3 and LOT 4 OF BLOCK 3 OF THE STURLA SCHOOL ADDITION AND BETWEEN LOTS 1 and 12 OF THE STURLA SCHOOL ADDITION BE IT RESOLVED by the City Council of the City of Lodi as follows: Section 1. It is the intention of the City Council of the City of Lodi, acting in accordance with the provisions of Part 3 of Division 9 of the Streets and Highways Code of the State of California, to vacate, close, and abandon as public alleys the following alleys situated in the City of Lodi, County of Sin Joaquin, State of California, more particularly described as follows, to wit: Parcel I - The alley adjacent to the south lines of Lots 1, 2, and 3 and the north line of Lot 4 in said Block 3, STURLA SCHOOL ADDITION. Parcel Ii - The alley adjacent to the west line of Lot 1, and the east line of Lot 1Z in said Block 3, STURLA SCHOOL ADDITION. EXCEPT for that portion lying north of the building setback line as established by the City of Lodi Ordinance No. 563 and recorded August 24, 1956 in Book 1896, page 523, Official Records, San Joaquin County Records. Reserving, however, and excepting from the vacation of said alleys, the permanent easement and the right therein to construct, maintain, repair and operate lines for public utilities, both publicly and privately owned, in, over, and across said alleys. Reference is hereby made to a map or plan on file in the office of the City Clerk for particulars as to the proposed vacation. Section 2. NOTICE IS HEREBY GIVEN that this City Council does hereby fix WEDNESDAY, June 18, 1975, at the hour of 8:00 o'clock p.m, and the City Council Chambers, City Hall, Lodi, California, as the time and place when and where all persons interested in or objecting to the vacation herein Page No. 2 proposed may appear before this City Council and be heard. Section 3. Upon adopting of this resolution the Superintendent of Streets shall post, or cause to be posted, notice of such passage and of the time, form and manner as prescribed by law for the vacation of streets. Section 4. This resolution shall be published one time in the "Lodi News Sentinel," a newspaper of general circulation printed and published in the City of Lodi, said publication to be completed at least fifteen days prior to said hearing.
