HomeMy WebLinkAboutResolutions - No. 4012i RESOLUTION NO. 4012 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF LODI OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "NEUHARTH-EAST ADDITION", AND GIVING NOTICE OF TIME AND PLACE FOR HEARING PROTESTS THERETO. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LODI: I. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of not less than one-fourth of the land in the hereinafter descried territory, by area and by assessed value as shown on the last equalized assessment roll of the County of San Soaquin, was filed with the Council of the City of Ladi on August 7, 1974, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be annexed to the City of Lodi and which said City and its Council propose to annex is situate in the County of San Joaquin, State of California, hereby desig- nated "Neuharth - East Addition", and described as follows: A portion of the North one-half of Section 13, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, being more particularly described as follows: Beginning at the intersection of the West line of the Southern Pacific Raiiroad right of way with the South line of said North one-half (said point being also in the existing City Limit line as described by City of Lodi Ordinance No. 901, J. C. BECIFNIAN ADDITION); thence South 87" 42' 00" West, along said South line and existing City Limit line, 742. 05 feet to the East line of CHURCH STREET (40 feet wide); thence North Z' 00' 00" East, along said East line and existing City Limit line, 285.78 feet; thence continuing along the existing City Limit line North 87" 45' 50" East, 75I. 49 feet to a paint in the West line of said Southern Pacific Railroad right of way; thence North 3' 54' 00" East, along said West line and existing City Limit line, 2 17. 14 feet to the Southeast corner of COEHRINC ADDITION as described by City of Ladi Resolution No. 3669; thence continuing North 3" 54' 00" East, along the existing City Limit line and West line of said Southern Pacific Railroad right of way, 809.49 feet to the Southwest corner of MELHAFF ADDITION as described by City of Lodi Resolution No. 2962; thence North 87' 42' 00" East, parallel to the South line of said North one- half, and along the existing City Limit line, 1073.49 feet, more or less, to the East line of Stockton Street (40 feet wide): thence leaving said existing City Limit line South 00" 05' West along said East line, parallel with and 20. 00 feet easterly of (measured at right angles), the East line of the Northwest Quarter of said Section 13, a distance of 1305.86 feet, more or less, to a point in the South line of the North one-half of said Section 13; thence South 87' 42' West, along the South line of said North one-half of Section 13, a distance of 1160. 92 feet, more or less, to the intersection with the West line of the Southern Pacific Railroad right of way and the point of beginning. Containing 38. 3 acres, more or less. I That the Local Agency Formation Commission of San Joaquin County California, did in session duly assembled on Friday, July 19, 1'174, consider and approve the proposed annexation of said "1leuharth- East Addition", as above described, and as submitted to said Commission by the proponents of said annexation. 4. That Wednesday, February 5, 1975, at the hour of 8:00 p. rr.. in the Council Chambers in the City Hall in the City of Lodi, County of -2- San Joaquin, California. is hereby fixed as the time and the place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Lodi, and having any objections to the proposed annexation, may appear before the Council of the City of Lodi and show cause why such unin- habited territory should not be so annexed to the City of Lodi. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation. and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 5. The City Clerk of the City of Lodi is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the "Lodi News Sentinel", a newspaper of general circulation published in said City of Ladi, the city to which it is proposed to annex the aforesaid territory, and also in the "Stockton Record", a newspaper of general circulation published outside the City of Lodi, but in the County of San Joaquin, Caliiornia, the county in which is located the territory proposed to be annexed to the City of Lodi, said publication to be complete at least twenty days prior to the date set for hearing. 6. The said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed was assessed in the iast equalized county assessment roll available on the date the above said proceedings were initiated, at the address shown on said assessment roll or known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest. either legal or equitable, with said Clerk, such notice to be given not leis than twenty days before the first public hearing on the proposed annexation. -3 7, In the event there is, upon the land proposed to be annexed to said City, a structural improvement owned, being acquired or leased by a county fire protection district, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten days before the first public hearing upon such proposed annexation. 8. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
