HomeMy WebLinkAboutResolutions - No. 3982RESOLUTION NO. 3982 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI, CALIFORNIA, DECLARING ITS INTENTION TO CALL FOR BIDS FOR A CERTAIN OIL AND GAS LEASE AND MAKING FINDINGS IN CONNECTION THEREWITH The City Council of the City of Lodi, California, does resolve as follows: SECTION 1 - That certain form of Subsurface Oil and Gas Lease presented to the City Council, with the original filed in the Office of the City Clerk at the Council Meeting this date, is hereby referred to and by this reference incorporated herein. SECTION 2 - Pursuant to Section 7058. 5 of the Public Resources Code of the State of California, the City Council declares that it intends to call for bids for an oil and gas lease in the form of the lease referred to in Section 1 of this Resolution. The property to be leased is situated in the County of San Joaquin. State of California, and is described as follows: Parcel 1: A 525. 14 acre tract of land located in Sections 23 and 24, Township 3 North, Range 5 East, M. D. B. &M. Parcel 2: All that certain parcel of land deeded to the City of Lodi by the State of California, as shown on Deed recorded March 14, 1973, in Book 3745, Page 33 of Official Records of San Joaquin County, containing 0. 38 acres, more or less. Parcel 3: All that certain parcel of land deeded to the City of Lodi by the State of California, as A. shown on Deed recorded March 14, 1973, in Book 3745, Page 28 of Official Records of San Joaquin County, containing 0. 59 acres, more or less. Parcels 1, 2, and 3, are commonly known as the White Slough Water Pollution Control Plant property. Parcel 4: A tract of land containing 16.64 acres. more or less, located in the South Half of Section 14, Township 3 North, Range 6 East, M.D.B. &M. , which Parcel is commonly referred to as "Beckman Park". Parcel 5: A parcel of land containing 27.00 acres, more or less. located in the North Half of the Southeast Quarter of Section 15, Township 3 North, Range 6 East, M.D. B. &M. , which parcel is commonly known as ''G -South Basin". For more detailed description, reference is hereby made to Exhibit "A" appended to proposed form of Subsurface Oil and Gas Lease, hereinabove referred to in Section 1 which is on file in the Office of the City Clerk of the City of Lodi. SECTION 3 - The royalty share payable for oil, gas, and other hydrocarbons produced from wells on the leased land shall be one-sixth ( 1/6), to be computed as provided in said form of lease. The one variable bidding factor upon which bids shall be received shall be the cash bonus consideration, including the first year's rental. The minimum rental per year during the primary term shall be as _2_ specified in paragraph 4 of the lease. The term of the lease shall be for a period of five (5) years and for such longer period (not to exceed 35 years) during which oil, gas and other hydrocarbon sub- stances shall be produced irom the leased land, or lands with which the leased land may be pooled. Lessor will permit drill sites on Parcel 1 at such locations as may be mutually agreed upon by Lessor and Lessee. SECTION 4 - None of the land described in the form of lease hereto has been used, owned, dedicated or acquired as parks, highways, streets, walks or public playgrounds for park, highway, street, walk or playground purposes. SECTION 5 - The bidder shall submit his bid in letter form accompanied by a Certified or Cashier's check in the full amount of the cash bonus consideration, including rental, bid for the first year. The bid shall set forth the said cash bonus consideration, and shall indicate bidder's willingness to enter into a lease in all respects identical to the lease referred to in Section 1, except for the identity of the Lessee. SECTION 6 - Bids far said Agreement of Lease are hereby invited and shall be received in the office of the City Clerk located in the City Hall, Lodi, California, until 5:00 o'clock p. m, on Wednesday, the 16th day of October, 1974, and shall be opened and publicly de- clared by the Council at 8:00 o'clock p.m. on said date. SECTION 7 - The City Clerk shall publish this resolution once a week for four successive weeks in the Ladi News Sentinel, a newspaper of general circulation published and printed in the City and County where the property is situated. all 3982 PASSED AND ADOPTED THIS 18TH DAY OF SEPTEMBER 1974 I hereby certify that the foregoing resolution was passed and adopted by the City Council of the City of Lodi in regular meeting held September 18, 1974 by the following vote: AYES: Councilmen - Ehrhardt, Hughes, Katnich, and Pinkerton (Mayor) NOES: Councilmen - None ABSENT: Councilmen- Schaffer Dated: September 18, 1974 -4- 3982
