RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY
OF LODI OF UXINHABITED TERRITORY DESCRIBED HEREIN AND
DESIGNATED "NEUH.-.RTH-WEST ADDITION" , AND GIVING NOTICE
OF TIME AND PLACE FOR HEARING PROTESTS THERETO
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LODI:
1. That, pursuant to the provisions e.' the Annexation of Uninhabited
Territory Act of 1939, a petit: cn signed by owners of not less than one-fourth
of the land in the hereinafter described territory. by area and by assessed
value as shown oa the last equalized assessment roll of the County of San
Joaquin, was filed with the Council of the City of Lodi on July 3, 1974.
requesting annexation of the hereinafter described territory to said City.
2. That the territory which the petitioners request be annexed to the
City of Lodi and which said City- and its Council propose to annex is situate in
the County of San Joaquin, State of California, hereby designated ''Neuharth -
West Addition:' and described as follows:
A portion of the Northwest Quarter of Section 13,
Township 3 North, Range 6 East, Mount Diablo Base and .Meridian,
being more particularly described as follows:
Beginning at the tntersecticn of the south 1ina ci said
Northwest one-quarter section with the centerline of Church Street
(40 feet wide), said pcint being shown on Map of Survey filed in Book
of Surveys, Volume 14, page 122, Sar. Joaquin County Records, said
centerline also being on the existing City Limit line of the City of
Lodi, as described by City of Lodi Ordinance No. 924, ROBBY'S
ADDITION: thence North 02" 00' 00" East along said centerline and
City Limit line. 30.00 feet; thence along said City Limit line the
following four courses: ( 1) South 87" 25' 30" West, 200.00 feet,
(z) North 02" 00' 00" East, parallel with the centerline of said
Church Street, 300.00 feet, (3) North 87' 25' 30" East. 10.00 feet,

and (4) North 02" 00' 00" East, parallel with the centerline of said
Church Street, 170.00 ieet to a point in the existing City Limit line
as described by City of Lodi Resolution No. 3669, GOEHRING ADDITION:
thence North 87' 25' 30" East along said City Limit line and south
line of said Goehr4ng Addition, 210. 05 feet to the East right of way
line of said Church Street: thence North 87* 40' East continuing along
said City Limit ;.ine and south line c*: said Goehring Addition, 758.80
feet to the west line of the Southern Pacific Railroad 100 foot wide right
of way, said south line of Goehring Addition being the North line of
those certain parcels o 'Land sbovrii or. %lap of Survey filed in Book of
Surveys: Volume lo, page 67, San Joaquin County Records; thence
South 03" 54' 00" West along said west Railroad right of way line,

of land shown on said Map of Survey: th,nce South 87" 45' 50" West along
the south line of said 3. 146 Ac. Net parcel of land, 751.49 feet to the
east right of way line of said 40 foot -ire Church Street: thence South
02.° 00' 00" West along said eas; right of a a y line, 285.78 feet to a
point in aforesaid south line of the northwest one-quarter of said
Section 13: thence South 8?' 42' West along said south line, 20. 05 feet
to the point of beginning.
Containing 6. 1 acres, more or less.
3. That the Local Agency Formation Commission of San Joaquin
County, California, did in session duly assembled on Monday, June 24, 1974,
consider and approve the proposed annexation of said "Neuharth -West Addition",
as above described, and as submitted to said Commission by the proponents of
said annexation,
4. That Wednesday, August I, i,'P.at the hour of 8:00 p, m. in the
Council Chambers in the City Hall in the City of Lodi. County of San Joaquin,

California, is hereby fixed as the time and the place when and where any
person owning real property within the uninhabited territory above described
and proposed to be annexed to the City of Lodi, and ha-iing any objections to
the proposed annexation, may appear before the Council of the City of Lodi
and show cause why such aninhabited territory should not be so annexed to
the City of Ladi. The protest must tF .r. wr=ting, may be filed at any time
before the hour set for hearing ebjecFtcns uo the proposed annexation. and
shall state the name or names of the owner or owners of property affected
and the description and area of such property, in general terms.
5. The City Clerk of the City of Lodi is hereby authorized and
directed to cause a copy o; 0 -,is resolut rn is be published at least twice, but
not oftener than once a week, in the Lod: News Sentinel", a newspaper of
general circulation published in sa_d City of Lodi, the city to which it is
proposed to annex the aforesaid territory, and also in the "Stockton Record",
a newspaper of general circulation published outside the City of Lodi, but in
the County of San Joaquin, Galifcrnsa, the county in which is located the
territory proposed to be annexed t i :hi Cr.t: of Ledi, said publication to be
complete at least twenty days prior tc the date set for hearing.
6. The said City Clerk is further authorized and directed to cause
written notice of such proposed an:-iexat-cn to be mailed to each person to
whom land within the territory proposed to be annexed was assessed in the
last equalized county assessment roll available on the date the above said
proceedings were initiated, at the address shown on said assessment roll
or known to said Clerk, and to any person who has filed his name and address
and the designation of the lands in which he has an interest, either legal or
equitable, with said Clerk, such notice to be given not less than twenty days
before the first public hearing on the proposed annexation.

7. In the event there is. upon the land proposed to be annexed to
said City, a structural improvement owned, being acquired or leased by a
county fire protecticn district, the City Clerk is directed to cause written
notice of such proposed annexation to be mailed to the governing body of
such district, such notice to be sent not less than ten days before the first
public hearing upon such proposed a .nexatlon.
8. The City Clerk is directed ca :rause written notice to be given
to such other persons as may be legally entitled thereto, in the mannez
required by law.
