CALLING A PUBLIC IE ARING TO DETERMINE WHETHER PUBLIC
NECESSITY, HEALTH, SAFETY, CR WELFARE REQUIRES THE
FORMATION OF AN UNDERGROUND UTILITY DISTRICT 2, LOCATED
BETWEEN CHURCH AND SACRAMENTO STREETS AND OAK AND
WALNUT STREETS
BE IT RESOLVED by the Council of the City of Lodi as follows:
WHEREAS, Ordinance No. 937 established a procedure for the creation of
underground utility districts and requires as the initiol step in such procedure the
holding of a public hearing to ascertain whether public necessity, health, satiety or
welfare requires the removal of poles, overhead wires and associated overheod structures
and the underground installation of wires and facilities for supplying electric, communica-
tion, or similar or associated service in any such district; and
WHEREAS, it has been recommended that such an underground utility district,
hereinafter called Underground Utility District 2, be formed to encompass the area in
the City of Lodi described as follows:
Beginning at the point of intersection of the West line of Church Street
and the North line of Walnut Street, the point known as the Southeast corner
of Lot 5, Block 5, City of Lodi; thence northerly along the West right-of-
way line of Church Street to the Northwest corner of Church Street and Oak
Street; thence Easterly along the North right-of-way line of Oak Street to the
Northeast corner of Oak Street and Sacramento Street; thence Southerly along
the East right-of-way line of Sacramento Street to the Northeast corner of
Sacramento Street and Walnut Street; thence Westerly along the North right-
of-way line of Walnut Street to the point of beginning.
NOW, THEREFORE, BE IT RESOLVED as follows:
1. NOTICE 15 HEREBY GIVEN that o public hearing will be held by the Council
of the City of Lodi on June 5, 1974, at the hour of 8:00 p.m. in the Council Chambers
of the City Hall, Lodi, California, to ascertain whether the public necessity, health,
safety, or welfare requires the removal of poles, overhead wires and associated
overhead structures and the underground installation of wires and facilities for supplying
electric, communication, or similar associated service in the District hereinabove described.
2. At such hearing all persons interested shill be given an opportunity to be heard.
Said hearing mc;y be continued from time to time as may be determined by the City
Council.
3. The City Clerk shall notify all affected property owners as shown on the last
equalized assessment roll and utilities concerned of the time and place of such hearing
by mailing a copy of this resolution to such property owners and utilities concerned at
least ten (10) days prior to the date thereof.
4. The area proposed to be included in the District is shown upon that certain
map entitled City of Lodi Underground Utility District 2, dated May 1, 1974, which
is on file in the office of the City Clerk of the City of Lodi.
