HomeMy WebLinkAboutResolutions - No. 3727RESOLUTION NO. 3727 CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT I, LOCATED BETWEEN CHURCH AND SACRAMENTO STREETS AND LODI AVENUE AND WALNUT STREET BE IT RESOLVED by the Council of the City of Lodz as follows: WHEREAS, Ordinance No. 937 established a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such district; and WHEREAS, it has been recommended that such an underground utility district, hereinafter called Underground Utility District I, be farmed to encompass the area in the City of Lodi described as follows: Beginning at the point of intersection of the West line of Church Street and the North line of Walnut Street, the point known as the Southeast corner of Lot 5, Block 5, City of Lodi; thence easterly along the North right of way line of Walnut Street to a point at the Northeast corner of Walnut Street and Scramento Street; thence southerly along the East right of way line of Sacramento Street to the Northeast corner of Sacramento Street and Lodi Avenue, which paint is the Southwest corner of Lot 7, Block 19, City of Lodi; thence westerly along the North right of way line of Lodi Avenue to the Northwest corner of Lodi Avenue and Church Street, which point is the Southeast corner of Lot 4, Block 9, Hutchins Addition to Lodi; thence northerly along the West right of way line of Church Street to the point of beginning. NOW THEREFORE, Be it Resolved as follows: 1. NOTICE IS HEREBY GIVEN tbatapublic hearing will be held by the Council of the City of Lodi on March 7, 1973, at the hour of 8:00 P. M. in the Council Chambers of the City Hall, Lodi, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar associated service in the District hereinabove described. - I.- 3 7 z°7 2. At such hearing all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 3. The City Clerk shall notify all, affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten ( 13) days prior to the date thereof. 4, The area proposed to be included in the District is shown upon that certain map entitled City of Lodi Underground Utility District 1 dated February 7, 1973, which is on file in the office of the City Clerk of the City of Lodi.
