HomeMy WebLinkAboutResolutions - No. 3726RESOLUTION NO, 372.6 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI ESTABLISHING THE DOWNTOWN UNDERGROUND UTILITY MASTER PLAN AREA ENCOMPASSING THE DOWNTOWN AREA OF THE CITY OF LODI LOCATED BETWEEN CHURCH STREET, SACRAMENTO STREET, LODI AVENUE, AND LOCUST STREET 13E IT RESOLVED by the Council of the City of Lodi as £oilows: WHEREAS, by Resolution No. 3706, a public hearing was called for February 7, 1973, at the hour of 8:00 p. m. in the Council Chambers in the City Hall, Lodi, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within the area in the City of Lodi described as follows: Beginning at the point of intersection of the West line of Church Street and the South line of Locust Street, the point known as the Northeast corner of Lot 4, Block 2, City of Lodi; thence Easterly along the South right-of-way line of Locust Street to a paint at the Southeast corner of Locust Street and Sacramento Street, which point is the Northwest corner of Lot 1, Block 20, City of Lodi; thence Southerly along the East right-of-way line of Sacramento Street to the Northeast corner of Sacramento Street and Lodi Avenue, which paint is the Southwest corner of Lot 7, Block 19, City of Lodi; thence Westerly along the North right-of-way line of Lodi Avenue to the Northwest corner of Lodi Avenue and Church Street, which point is the Southeast corner of Lot 4, Block 9, Hutchins Addition to Lodi; thence Northerly along the West right-of-way line of Church Street to the point of beginning. WHEREAS, said proposed Master Plan was submitted to the Planning Cornmisston of the City of Lodi, and at its meeting on January 22, 1973, said Gomnii.ssion determined that the proposed Downtown Underground Utility Master Plan conio.rm.s with the general plan of the City of Lodi; and WHEREAS, said Planning Commission has further determined that there will be no environmental impact upon the City of Lodi by reason of the undergrounding of utilities within said area; and -1- WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and the Utilities concerned in the manner and for the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; and NOW, THEREFORE, 13E IT RESOLVED by the Council of the City of Lodi as follows: 1. That the public necessity, health, safety, and welfare of the citizens of Lodi requires the removal of poles, overhead wires, and associated overhead structures with all of said wires and facilities necessary for supplying electric, com- muriication, or similar or associated service to be hereafter constructed underground within the underground utility districts hereinafter established within the area described all in accord- ance with the applicable rules, regulations and tariffs of the respective utility or utilities on file with the utility or California Public Utilities Commission. That the above-described area is hereby declared to be the Downtown Underground Utility Master Plan Area of the City of Lodi, and attached hereto, marked Exhibit A and hereby incor- porated as part of this resolution, is a reap delineating the boundaries of said District. 3. That the Council shall by resolution establish underground utility districts with;. his Dczwntow i Unclergrounci Utility Master Plan Area at such times that are considered feasible and in accordance with Ordinance No. 937.
